Abstract

V magistrskem delu je analizirano, s kakšno problematiko se srečuje Republika Slovenija in tudi Republika Hrvaška v postopkih izvajanja ribolova v spornem delu Piranskega zaliva. Za magistrsko delo je bil zelo pomemben vir arbitražna razsodba; z njeno razglasitvijo se je končal arbitražni postopek med Republiko Slovenijo in Republiko Hrvaško 29. 6. 2017. Razsodba je dokončna in zavezujoča za obe pogodbenici, skladno z arbitražnim sporazumom in načeli mednarodnega prava. Z arbitražno razsodbo je bila prvič določena meja na kopnem in morju med državama, določen je bil stik Republike Slovenije z odprtim morjem (skladno z načelom pravičnosti in dobrososedskih odnosov za dosego poštene in pravične odločitve) in režim za uporabo ustreznih morskih območij. Ribolov se označuje kot pomemben vir preživetja od pradavnine vse do danes. Morje in pravica do ribolova sta postala splošni dobrini šele v 19. stoletju. Inšpektorat Republike Slovenije za kmetijstvo, gozdarstvo, lovstvo in ribištvo, natančneje Lovska in ribiška inšpekcija, je leta 2005 postal prekrškovni organ. Kot je bilo razvidno iz osmega poglavja magistrskega dela, nadzor in kontrolo na območju Piranskega zaliva izvaja Inšpekcija za morsko ribištvo, in sicer skladno z izrečeno arbitražno razsodbo. V magistrskem delu sta predstavljena dva konkretna prekrškovna postopka, ki ju je vodil Inšpektorat RS za kmetijstvo, gozdarstvo, lovstvo in ribištvo zoper hrvaška ribiča, ki sta izvajala nedovoljen ribolov. Na podlagi predstavitve je bilo razvidno prikazano, da uveljavitev arbitražne razsodbe na področju ribištva v Republiki Sloveniji predstavlja veliko problematiko. Ugotovljeno je, da je od leta 2018 mogoče zaznati nekorektno ravnanje tako Republike Slovenije kot tudi Republike Hrvaške v zvezi z izvajanjem ribolova v Piranskem zalivu, ki se kaže v spremstvu policije posamezne države. Navedbe, ki sta jih vsa ta leta uporabljali obe državi, da ribiči ne bodo utrpeli nobenih stroškov, saj je za to zagotovljeno s pravnimi akti obeh držav, ne vodijo do nobene rešitve problema. Dejstvo je, da so operativne in tehnične službe naredile vse, kar je bilo v njihovi pristojnosti. Iz številčnosti prekrškovnih postopkov, ki jih operativne in tehnične službe vodijo proti hrvaškim ribičem, je razvidno, da ravnanja teh služb ne dajejo velike legitimnosti, saj se dejanja hrvaških ribičev vsakodnevno ponavljajo in številčno tudi naraščajo.

Secondary abstract: The master's thesis analyses what issues the Republic of Slovenia and also the Republic of Croatia is facing in fishing operations in the disputed part of the Piran Bay. A very important source for the master's thesis was the arbitration award, with the announcement of which on June 29th 2017 the arbitration procedure between the Republic of Slovenia and the Republic of Croatia ended. The award is final and binding for both parties, in accordance with the arbitration agreement and principles of international law. The arbitral award determined the land and sea border between the two countries for the first time, determined was the contact of the Republic of Slovenia with the high seas (in accordance with the principle of fairness and good neighbourly relations to achieve a fair and just decision) and the regime for the use of appropriate sea areas. Fishing is described as an important source of livelihood from ancient times to the present day. The sea and the right to fish became common goods only in the 19th century. In 2005, the Inspectorate of the Republic of Slovenia for Agriculture, Forestry, Hunting and Fisheries, more precisely the Hunting and Fishing Inspectorate, became an offence authority. As was evident from the eighth chapter of the master's thesis, supervision and control in the area of the Piran Bay are carried out by the Marine Fisheries Inspectorate, in accordance with the arbitration award. The master's thesis presents two specific offence proceedings conducted by the Inspectorate of the Republic of Slovenia for Agriculture, Forestry, Hunting and Fishing against two Croatian fishermen, who engaged in illegal fishing. On the basis of the presentation, it was evident that the enforcement of the arbitration award in the field of fisheries in the Republic of Slovenia represents a major issue. It was found that since 2018 it is possible to detect incorrect conduct of both the Republic of Slovenia and the Republic of Croatia in relation to fishing in the Piran Bay, which is manifesting with the presence of the police of both countries. The allegations used by both countries over the years that fishermen will not incur any costs, as provided for by the legal acts of both countries, do not lead to any solution of the problem. In fact, the operational and technical services did everything in their power. The number of offence proceedings conducted by operational and technical services against Croatian fishermen shows that the actions of these services do not provide much legitimacy, as the actions of Croatian fishermen are being repeated every day and are increasing in number.
