Abstract
Do šestdesetih let prejšnjega stoletja je kriminaliteta zoper umetnine veljala za tisto vrsto kriminalitete, v katero se vključujejo predvsem osebe, ki prihajajo iz višjih slojev. V zadnjih petdesetih letih pa je nenehna rast vrednosti umetnin botrovala temu, da so umetnine postale zanimive tudi organiziranim kriminalnim združbam, ki dobiček od trgovine z umetninami večinoma vlagajo v druge nezakonite posle, z nakupom umetnin operejo denar, pridobljen z nezakonitimi posli, ali pa jim umetnine služijo kot sredstvo blagovne menjave za drugo prepovedano blago.
Pri preiskovanju organizirane kriminalitete, povezane z umetninami, se preiskovalci srečujejo z najrazličnejšimi problemi. V prvi vrsti je znotraj večine policijskih služb premalo znanja za preiskovanje in odkrivanje tovrstne kriminalitete. Eden pomembnejših problemov je tudi ozaveščenost javnosti, katera se ne zaveda, kako pomembno je trgovanje z umetninami za organizirane kriminalne skupine. Pogosto se tudi dogaja, da oškodovanci zaradi različnih razlogov kaznivih dejanj ne prijavljajo, kar pomeni, da ima policija malo delovne prakse na področju preiskovanja tovrstne kriminalitete in ji posledično posveča (pre)malo pozornosti. Obstajajo seveda tudi izjeme, saj imajo nekatere države znotraj policije ustanovljene posebne oddelke zgolj za preprečevanje in preiskovanje kriminalitete, povezane z umetninami.
Iz analize primerov bo v diplomskem delu mogoče razbrati osnovne probleme preiskovanja kaznivih dejanj, povezanih z umetninami, razvidno bo, katere metode preiskovanja lahko pripeljejo do uspeha, mogoče pa bo tudi ugotoviti, katere so tiste lastnosti, ki se po navadi pojavljajo soodvisno, ko je organizirana kriminaliteta vpletena v kazniva dejanja, povezana z umetninami.

Up until the 60’s of the previous century, art crime was most often thought of as being perpetrated by the people of the higher social classes. But in the last fifty years, increasing appreciation of art products has been one reason why they became popular among organized crime groups. Profits, created by these organized crime groups trading art, is then most often invested in diverse illicit transactions (like drug trade, for example) and/or in purchase of artworks with intention to launder the illegally obtained money. Also, the objects of art are part of trade exchange for other prohibited goods.
Investigating the organized art related crimes has its problems which for the investigators are difficult to overcome. Firstly, there is a major problem within most police departments - the lack of knowledge and experience to investigate art crime. Second noticeable problem is the lack of awareness among public which consequently leads to not knowing how important art crime is to organized crime groups. Often there is the case of owner not reporting the offence for various reasons. The consequence of this phenomenon is that police has no art crime cases to work on, which leads to inexperienced police force and consequentially police won’t pay much attention to this type of crime because they see it as irrelevant. Of course, there are also some exceptions of the mentioned attitudes. Some of the police forces of different nations have established special sections which are focused solely on prevention and investigation of art crime.
Through reweaving the selected case studies the diploma thesis presents the basic problems of art crime investigation. It also informs about the important investigative methods used by the law enforcement agencies that are most likely to be successful. Furthermore, the properties of certain characteristics that usually co-occur when the organized crime is related with art crime (like violence for example), are presented. |
