Abstract
Diplomska naloga obravnava zakonsko definicijo kaznivega dejanja posilstva. V uvodnem delu so predstavljene tri hipoteze, ki predstavljajo gonilo diplomskega dela. Namen in cilj diplomske naloge sta obravnava spolnega kazenskega prava ter ustreznost inkriminacije spolnega ravnanja brez privolitve. Od junija 2021 v slovenskem pravnem sistemu velja opredelitev kaznivega dejanja posilstva po modelu afirmativnega soglasja, ki za obstoj kaznivega dejanja ne zahteva več prisilitvenega ravnanja, ampak je ta delikt opredeljen kot doseganje spolnega ravnanja brez veljavne privolitve druge osebe. Diplomska naloga obravnava tudi primer spolnega napada na spečo osebo iz sodne prakse, ki je v javnosti sprožil bujen odziv, ko je sodišče dejanje opredelilo kot kaznivo dejanje spolne zlorabe slabotne osebe, saj je storilec silo uporabil šele, ko se je žrtev zbudila in začela upirati. Šlo je za očitno napako sodišča in ne primer ustaljene sodne prakse, ki pa je vendarle bila povod za redefinicijo kaznivega dejanja posilstva. Namen in cilj diplomske naloge je tudi pregled zgodovinskega razvoja definicije posilstva, nekaterih pojavnih oblik posilstva, zlasti posilstva v zakonski zvezi ter posilstva na zmenku, pa tudi obravnava stereotipov ter odnosa do žrtev posilstva ter ugotovitve o odzivanju žrtev. V zaključnem delu diplomske naloge sledi preučitev zastavljenih hipotez ter njihova potrditev ali zavrnitev. S pomočjo analiziranih modelov kazenskopravne ureditve posilstva, kjer so za vsak model opisane tudi prednosti in slabosti, lahko bralec ustvari mnenje o tem, kateri model se mu zdi najprimernejši.

The Bachelor's thesis deals with the legal definition of the crime of rape. In the introductory part, three hypotheses, which represent the motive of the thesis, are presented. The purpose and goal of the thesis is to discuss sexual offences in criminal law and the adequacy of the incrimination of sexual conduct without consent. From June 2021, the Slovenian legal system defines the crime of rape according to the model of affirmative consent, which no longer requires coercive conduct for the existence of a crime, but this offense is defined as achieving sexual conduct without the valid consent of another person. The thesis also deals with a case of sexual assault on a sleeping person from case law, which provoked a public response when the court defined the act as a crime of sexual abuse of a weak person, as the perpetrator used force only when the victim woke up and began to resist. This was not an example of established case law, but an obvious error, which was the reason for redefining the crime of rape. The purpose and goal of the thesis is to review the historical development of the definition of rape, some forms of rape, especially marital rape and date rape, as well as the treatment of stereotypes and attitudes towards rape victims and findings on their emotional reaction to the crime. The final part of the thesis is followed by an examination of the set hypotheses and confirmation or rejection of them. With the help of the analyzed models of the criminal law regulation of rape, where the advantages and disadvantages are described for each model, the reader can form a judgement about which model he finds the most suitable. |
