Abstract
Policija je na splošno gledano preobremenjena zaradi številnih nalog, ki jih mora opravljati. Ker pa ni edina organizacija v Sloveniji, ki opravlja policijsko dejavnost, se zastavlja vprašanje, ali bi lahko ob ustrezni zakonodaji določene preprostejše naloge, ki so sedaj v izrecni pristojnosti policije, lahko opravljal tudi kdo drug, konkretneje detektivi. Pregled literature in zakonodaje v sosednjih državah Slovenije, Veliki Britaniji in Združenih državah Amerike, pokaže, da v nekaterih državah detektivi že opravljajo mnogo policijskih nalog, pri čemer prednjači Velika Britanija. Tudi v Avstriji detektivi že lahko vodijo preiskave kaznivih dejanj in celo opravljajo zaščito ljudi in nepremičnin, v kolikor je to povezano z zaščito ljudi. Na podlagi pregleda literature in opravljenih intervjujev s slovenskimi detektivi smo prišli do zaključka, da bi s spremembo zakonodaje, ki ureja delovanje policije in detektivov, lahko določene policijske naloge popolnoma ali vsaj deloma prenesli na detektive. Takšne policijske naloge se nanašajo predvsem na preiskovanje kaznivih dejanj na zasebno tožbo in preiskovanje določenih kaznivih dejanj, ki se preganjajo na predlog (npr. kaznivo dejanje tatvine, velike tatvine in poškodovanje tuje stvari). Detektivi bi lahko opravljali tudi nadzor karanten v času epidemij. Zgolj sprememba zakonodaje pa ne bi bila dovolj, ampak bi ob prevzemu določenih policijskih nalog detektivi zagotovo potrebovali tudi dodatna usposabljanja.

Possibility of transferring police tasks to detectives |

The police are generally overburdened by the many tasks they have to perform. However, since it is not the only organization in Slovenia that performs police activities, the question arises whether, with appropriate legislation, certain simpler tasks, which are now under the express competence of the police, could also be performed by someone else, specifically detectives. A review of the literature and legislation in Slovenia's neighboring countries, Great Britain and the United States of America, shows that in some countries detectives already perform many police tasks, with Great Britain leading the way. Even in Austria, detectives can already conduct criminal investigations and even perform protection of people and real estate, insofar as this is related to the protection of people. Based on a review of the literature and interviews with Slovenian detectives, we came to the conclusion that by changing the legislation governing the operation of the police and detectives, certain police tasks could be completely or at least partially transferred to detectives. Such police duties mainly relate to the investigation of criminal offenses on private prosecution and the investigation of certain criminal offenses that are prosecuted on the basis of a proposal (eg the crime of theft, grand theft and damage to another's property). Detectives could also supervise quarantines during epidemics. Merely changing the legislation would not be enough, but when taking over certain police tasks, detectives would definitely need additional training. |
