Nezakonite posvojitve kot oblika trgovine z ljudmi

Abstract

Bodoči posvojitelji se iz različnih razlogov odločajo za posvojitev otrok, bodisi iz domače države, bodisi iz tujine. Tako posvojitelji kot posvojenci morajo izpolnjevati določene kriterije, da se postopek posvojitve izvede in tudi zaključi na zakonit način. Kadar govorimo o posvojitvah kot obliki trgovine z ljudmi, bi lahko postopek posvojitve razdelili na tri dele: začetek, proces in zaključek posvojitve. Največ kaznivih dejanj, ki nakazujejo na nezakonite posvojitve se običajno izvede v začetku – ugrabitev otroka, njihov odkup, zavajanje ali med samim postopkom - ponarejanje uradnih dokumentov, prirejanje informacij in podobno. Trgovina z ljudmi običajno vključuje tri elemente, in sicer novačenje, prevoz in izkoriščanje. Če izhajamo iz omenjenih elementov pri nezakonitih posvojitvah ne moremo govoriti o tipični obliki trgovine z ljudmi, saj je praviloma namen posvojitve dobrobit otroka oziroma posvojencu najti najbolj primerne starše in ne njihovo izkoriščanje.

Secondary abstract:	Future adoptive parents are deciding to adopt a child because of various reasons. Adoptive parents can adopt a child from domestic or foreign country. Both adoptive parents and adopties must meet certain criteria for the adoption process to be carried out and also to be completed legally. When we talk about adoptions as a form of human trafficking, the adoption process can be divided in three parts: the beginning, the process and end of the adoption process. Most crimes indicating that the adoption is illegal are commited at the very beginning of the process – kidnapping of the child or their redemption, deception, or during the adoption process – forgery of official documents, carrying out dissinformation etc. Human trafficking usually consits out of three elements: recruitment, transport and exploitation of the victims. If we reflect illegal adoptions to these elements we can not talk about typycall form of human trafficking because element of exploitation is missing – purpose of adoption is mainly welfare of the child and finding most suitable parents for the adoptee.
