Abstract

The process of European integration and co-operation between the countries is accompanied by signing international agreements and other documents, which bind contracting parties and cause different effects. The way of putting an international agreement into force (in terms of international law and internal law as well), has a special meaning in this context. The article deals above all with internal law, however it is limited to temporary use of international agreements, i.e. the use of agreements before they are fully authorized. Although the institute of temporary use of international agreements seems to be at first glance very practical, it appears to be at more precise analysis of legal provisions, constitutionally controversial. Generally speaking, legitimacy of the institute is not contestable, it is included in Vienna convention on contract law (1969), in constitutions and legislations of many countries. However, when introducing possibility of temporary use of international agreements into the order of law, other segments which enable and assure respect of the rule of the law and the principles of division of power, has to be regulated more precisely.

Secondary abstract: Proces evropske integracije in sodelovanja držav spremlja sklepanje mednarodnih pogodb in drugih aktov, ki pogodbenice veže in povzroča različne posledice. Poseben pomen predstavlja način uveljavitve mednarodne pogodbe, tako v notranjepravnem kot tudi v mednarodnopravnem smislu. Prispevek obravnava predvsem notranjepravni vidik, vendar se omejuje zgolj na začasno uporabo mednarodnih pogodb, to je uporabo pogodb pred njeno polnopravno veljavnostjo. Navidez zelo praktičen institut začasne uporabe mednarodnih pogodb lahko pri natančni analizi pravnih določb, ki urejajo to problematiko, postane ustavno sporen. Splošno gledano, legitimnost instituta ni sporna, vsebujejo ga med drugim tudi Dunajska konvencija o pogodbenem pravu iz leta 1969, ustave in zakonodaje mnogih držav. Vendar pa je ob uvedbi možnosti začasne uporabe mednarodnih pogodb v pravni red potrebno natančnejše urediti tudi druge segmente, ki omogočajo in zagotavljajo spoštovanje načela pravne države in načela delitve oblasti.
