Sekundarni povzetek: | Article 50 TEU provides a legal basis for the withdrawal from the European Union which involves the national and European legal order. The goal of the withdrawal procedure was to enforce the suverenity of member states in light of the deepening of the European integration but the first withdrawal procedure shed a light on its downfalls. Through the use of the comparative and analytical method of research we compare not only the withdrawal of member states from international organisations but also secessions in order to use these findings in the analysis of Articel 50 TEU. The comparison of national legislations regarding the withdrawal from the EU, with a special ephasis on the Slovenian and UK legal order, offers some important information regarding the notification of withdrawal and competeces of national institutions in this process. The analysis of the Court of Court of Justice case law enhances teh understanding of questions relating to the second phase of the withdrawal procedure and the conclusion of teh agreement on future relationship between the EU and the former member state. The results of this research confirm the thesis on the legal underregulation of the withdrawal procedure in the national and European Union legislation. The national and European Union legislator must take action to regulate the withdarwal procedure in order to avoid legal uncertinity in the following withdrawal procedures. |
