Abstract
Mehanizme varstva lastninske pravice tretjih v izvršilnem postopku predstavljata ugovor tretjega in tožba zaradi nedopustnosti izvršbe, v stečajnem postopku pa prijava izločitvene pravice in tožba na uveljavitev prerekane izločitvene pravice. Omenjena pravna sredstva so bila v zadnjih nekaj letih predmet ustavne presoje. Ustavno sodišče jih je presojalo predvsem z vidika prekluzivnih rokov, ki jih imajo tretji na voljo, da uveljavljajo svojo lastninsko pravico. Na obeh področjih je bila ugotovljena kršitev pravice do zasebne lastnine. V magistrski nalogi so obširneje predstavljeni omenjeni mehanizmi v luči pravice do zasebne lastnine kot temeljne človekove pravice v povezavi s klasičnim stvarnopravnim varstvom lastninske pravice. Za lažje razumevanje problematike so predstavljeni tudi nekateri splošni instituti izvršilnega in stečajnega prava. Zaključiti je mogoče, da mehanizmi varstva lastninske pravice tretjih v izvršilnem in stečajnem postopku zasledujejo enake cilje kot lastninska tožba. Kljub odločbam Ustavnega sodišča, ki posegajo na to področje, je mogoče v trenutni ureditvi prepoznati določene neustavnosti in nedoslednosti. Trditi je mogoče, da nesuspenzivnost ugovora tretjega in tožbe tretjega zaradi nedopustnosti izvršbe, v pozvezavi s strogimi pogoji za odlog na predlog tretjega, pomenita kršitev pravice do zasebne lastnine tretjega. Prav tako je mogoče zaključiti, da 30 dnevni rok za vložitev tožbe zaradi nedopustnosti izvršbe pomeni kršitev pravice do zasebne lastnine tudi glede izvršbe na nepremičnine in ne samo premičnine, kot je v nedavno odločilo Ustavno sodišče.

The mechanisms for the protection of third-party property rights in enforcement proceedings are the third-party objection and the action for the inadmissibility of enforcement, and declaration of exclusion rights and the action for the contested exclusion right in insolvency proceedings. These remedies have been the subject of constitutional review in recent years. The Constitutional Court has primarily assessed the limitation periods available to third parties to enforce their property rights and concluded there has been a violation of the right to private property. The master's thesis presents the above-mentioned mechanisms in more detail in the light of the right to private property as a fundamental human right and in relation to the classical protection in rem. Some general institutions of enforcement and insolvency law are also presented to facilitate the reader's understanding. Mechanisms for the protection of third-party property rights in enforcement and insolvency proceedings pursue the same objectives as a property action. In the light of the constitutionality and protection of third-party property rights additional human rights violations and inconsistencies of the legislation in the field of insolvency and enforcement law can be traced, despite the Constitutional Court's interventions in the aforementioned areas. It is established that the lack of third-party proceedings and the third-party action for the inadmissibility of enforcement, in conjunction with the strict conditions for the third-party postponement of enforcement, constitute a violation of the third-party's right to private property. It can also be concluded that the 30-day time-limit for bringing an action for inadmissibility of enforcement also constitutes an infringement of the right to private property with regard to the enforcement of real estate and not only movable property, as recently held by the Constitutional Court. |
