Abstract

Pritožbo lahko posameznik vloži takrat, kadar se ne strinja z dejanjem ali opustitvijo dejanja represivnega organa, saj ti razpolagajo s pooblastili, med katerimi so tudi prisilna sredstva. Vsak organ mora že po zakonu varovati človekove pravice in njegove svoboščine, vendar se to ne zgodi vedno, zato je pomembno imeti ustrezno vzpostavljen pritožbeni mehanizem. Med najbolj razdelanimi je tisti v policiji, toda ker policisti niso edini, ki posegajo v človekove pravice in svoboščine, v tem zaključnem delu obravnavamo pritožbene postopke zoper delo občinskih redarjev, zasebnih varnostnikov in detektivov v Republiki Sloveniji in Republiki Hrvaški. Poleg pritožbenih postopkov smo predstavili še zakonsko ureditev, pooblastila in nadzor nad vsako dejavnostjo. Nadzor nad njimi mora biti vzpostavljen nepristransko in neodvisno. V obeh državah nadzor nad prej naštetimi dejavnostmi opravljata Ministrstvo za notranje zadeve in policija. Na Hrvaškem nadzor nad občinskimi redarji poleg ministrstva opravlja organ državne uprave pristojen za občinske zadeve, pri nas pa nad detektivsko dejavnostjo bdi Detektivska zbornica Republike Slovenije. Tako na Hrvaškem kot v Sloveniji je vzpostavljen pritožbeni mehanizem, ki posamezniku omogoča, da vloži pritožbo, če meni, da so mu bile z uveljavljenjem represivnih pooblastil, kršene njegove pravice. Toda skozi zaključno delo smo ugotovili, da pritožbeni mehanizmi ne zagotavljajo enake obravnave, zato bi se pri nas in v Republiki Hrvaški moral vzpostaviti samostojen pritožbeni organ, ki bi deloval ločeno od institucij in bi reševal pritožbe nad delom represivnih organov.

Secondary abstract: An individual can file a complaint when he disagrees with the action or omission of a repressive authority, as they have powers that include coercive means. By law, everybody must protect human rights and freedoms, but this does not always happen, so it is important to have a proper appeal mechanism in place. Among the most detailed is that of the police, but since police officers are not the only ones who encroach on human rights and freedoms, in this dissertation we discuss appeal procedures against the work of municipal wardens, private security guards and detectives in the Republic of Slovenia and the Republic of Croatia. In addition to appeal procedures, we also presented the legal regulation, authorizations and control over each activity. Control over them must be established impartially and independently. In both countries, the Ministry of the Interior and the police supervise the aforementioned activities. In Croatia, in addition to the ministry, the supervision of municipal police officers is carried out by the state administration body responsible for municipal affairs, while in our country, the Detective Chamber of the Republic of Slovenia oversees the detective activity. Both Croatia and Slovenia have established an appeal mechanism that enables an individual to file an appeal if he believes that his rights have been violated by the enforcement of repressive powers. However, through the dessertation, we found that the appeal mechanisms do not guarantee equal treatment, so an independent appeal body should be established in both our country and the Republic of Croatia, which would work separately from the institutions and resolve appeals about the work of repressive bodies.
