Abstract

V slovenski zakonodaji je skupno premoženje zakoncev opredeljeno kot skupek premoženjskih pravic, ki so bile v času trajanja zakonske zveze in dejanske življenjske skupnosti pridobljene odplačno ali z delom zakoncev. Skupno premoženje zakoncev pa je tudi premoženje, ki je pridobljeno na podlagi in s pomočjo skupnega premoženja. Podlago za nastanek skupnega premoženja zakoncev daje Družinski zakonik, po katerem skupno premoženje nastaja ex lege, pri čemer se nastanek skupnega premoženja domneva. Zakonca se sicer lahko s pogodbo o ureditvi premoženjskopravnih razmerij dogovorita o drugačni vsebini njunega premoženjskega režima, kot ga predpisuje zakon. Po zakonu sicer veljata dva premoženjska režima med zakoncema: režim premoženjske skupnosti za skupno premoženje zakoncev in režim ločenega premoženja za posebno premoženje vsakega od zakoncev. Magistrsko delo obravnava problematiko skupnega premoženja v primerih, ko se eden od zakoncev znajde v vlogi stečajnega dolžnika nad katerem se vodi postopek osebnega stečaja. Pri tem velja, da sta stečajni dolžnik in zakonec skupna imetnika premoženjskih pravic, ki so del skupnega premoženja, saj po splošnem pravilu velja, da skupno premoženje pripada obema zakoncema skupaj, deleži vsakega od njiju pa niso določeni. Zakonec zato sam ne more razpolagati z nedoločenim deležem na skupnem premoženju, kar nujno pomeni, da je v postopku osebnega stečaja, v katerem se opravi prodaja vsega dolžnikovega premoženja, treba za prodajo dolžnikovega deleža na skupnem premoženju izpeljati tudi postopek delitve skupnega premoženja zakoncev. Stečajni postopek se namreč vodi z namenom hkratnega poplačila vseh upnikov po enakih deležih iz celotnega premoženja stečajnega dolžnika. Delitev skupnega premoženja zakoncev v postopku osebnega stečaja pa je potrebna tudi iz vidika varstva zasebne lastnine zakonca stečajnega dolžnika, saj se v postopku osebnega stečaja sme poseči le na premoženje, ki je v lasti stečajnega dolžnika. Družinski zakonik v tem primeru uzakonja pravno fikcijo prijave izločitvene pravice zakonca na deležu skupnega premoženja, ki je enak polovici. Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju, ki ureja postopek osebnega stečaja, ne vsebuje posebnih določb, ki bi urejale postopek delitve skupnega premoženja, zato se glede vprašanj delitve skupnega premoženja zakoncev uporabijo pravila družinskega prava.

Secondary title: Asserting claims in rem over matrimonial property in insolvency proceedings
Secondary abstract: Slovenian legislation defines matrimonial property as the sum of property rights acquired for consideration or through the work of spouses during the marriage and actual legal union. The spouses' matrimonial property is also property acquired on the basis of and through matrimonial property. The basis for the formation of the joint property of the spouses is given by the Family Code, under which joint property arises ex lege, the creation of joint property is presumed. By means of a contract on the regulation of property relations, the spouses may agree on a different content of their property regime from that prescribed by law. By Family Code, two property regimes apply: the community of property regime for the matrimonial property regime and the separate property regime for the separate property of each of the spouses. The master's thesis deals with the issue of joint property in cases where one of the spouses finds himself or herself in the role of a bankruptcy debtor over whom personal bankruptcy proceedings are conducted. As a general rule, the bankruptcy debtor and the spouse are joint holders of property rights forming part of the joint property, since as a general rule, common property belongs to both spouses jointly, and the shares of each of them are not determined. Therefore, the spouse cannot dispose of an indefinite share of the joint property on his/her own, which necessarily means that in personal bankruptcy proceedings in which the sale of all the debtor's assets takes place, the procedure for dividing the spouses' joint property must also be carried out in order to sell the debtor's share of the common property. Bankruptcy proceedings are conducted with the aim of simultaneously reimbursing all creditors at equal shares in the total assets of the bankruptcy debtor. The division of the matrimonial property in personal bankruptcy proceedings is also necessary from the point of view of protecting the private property of the spouse of the bankruptcy debtor, since in personal bankruptcy proceedings only assets owned by the bankruptcy debtor may be interfered. In this case, the Family Code enacts the legal fiction of filing a spouse's right of exclusion on a share of the joint property equal to half. The Act on Financial Operations, Insolvency Proceedings and Compulsory Winding-up, which governs personal bankruptcy proceedings, does not contain specific provisions governing the procedure for the division of joint property, so the rules of family law apply to issues relating to the division of matrimonial property.
