Abstract

Zdravje in življenje sta nenadomestljivi dobrini in sta visoko varovani tako na ustavni kot zakonski ravni. Zdravniki v ti naši dobrini vsakodnevno posegajo pri svojem delu, zato je še toliko pomembneje, da ravnajo v skladu s skrbnostjo, ki se od njih zahteva, to je s skrbnostjo dobrega strokovnjaka. Pravna teorija in sodna praksa sta enotni, da zdravnik ne ravna kot bi moral, kadar je poslabšanje zdravja pacienta posledica njegovega strokovno nepravilnega ravnanja ali kadar je ravnanje po strokovni plati sicer neoporečno, vendar pacient v poseg ni privolil. Medicinske napake se dogajajo pogosto in osebe, ki so žrtve le teh, želijo zadoščanje za posledice. Zadoščanje iščejo skozi zapletene sodne postopke, kjer pa je za ugotavljanje odgovora na vprašanje, ali je do medicinske napake res prišlo, potrebna vključitev sodnega izvedenca medicinske stroke. Izvedenci medicinske stroke imajo v sodnih postopkih velik pomen, saj s svojim mnenjem vplivajo na končno odločitev sodišča. Kot strokovnjaki nudijo strokovno pomoč sodišču pri zadevah, za katera sodnik nima zadostnega znanja. Zato je še toliko pomembneje, da je izvedensko mnenje napisano strokovno neoporečno in objektivno, saj bo sodišče večinoma na podlagi mnenja izdalo odločbo, ki pa lahko ima velik vpliv na tožnika kot oškodovanca.

Secondary title: The issue of expert witness in determining medical malpractice
Secondary abstract: Health and life are irreplaceable goods and are highly protected both at the constitutional and legal levels. Physicians intervene in these goods on a daily basis in their work, making it even more important for them to act with the required diligence, that is the diligence of a good professional. Legal theory and judicial practice are unanimous that a physicians do not act as they should when the deterioration of a patient's health is a result of their professional misconduct or when the action, although professionally faultless, was not consented to by the patient. Medical errors happen frequently, and individuals who are victims of these errors seek compensation for the consequences. They seek satisfaction through complex legal proceedings, where determining whether a medical error truly occurred requires the involvement of a court-appointed expert in the medical field. Medical experts play a significant role in legal proceedings, as their opinions influence the court's final decision. As professionals, they provide expert assistance to the court in matters where the judge lacks sufficient knowledge. Hence, it is all the more crucial for the expert opinion to be written in a professionally impeccable and objective manner, as the court will often base its ruling on the opinion, which can have a substantial impact on the plaintiff as the injured party.
