Abstract
V današnjem digitalnem in tehnološko naprednem svetu se UI vse bolj uveljavlja kot pomembna sila, ki vpliva na številna področja človeške dejavnosti. Ena od panog, ki se sooča s prihodom UI, je tudi pravo. Družinsko pravo kot ena izmed vej prava tako pred prihodom UI ni zavarovana.
V magistrskem delu se bom osredotočila na vpliv, ki ga prinaša UI na družinsko pravo, ter preučila, kako se UI vključuje v pravne postopke in storitve, povezane z družinskimi zadevami. V tujini je že mogoče zaznati razvoj aplikacij, ki uporabljajo UI, predvsem v Združeninh državah Amerike (ZDA), Avstraliji, Kanadi in na Nizozemskem. Te aplikacije uporabljajo algoritme UI, da bi strankam omogočile enostavnejši in cenovno ugodnejši dostop do pravnih storitev ter hkrati razbremenile delo odvetnikov. Preučevanje različnih modelov uporabe UI v tujini nam bo omogočilo vpogled v njen vpliv na družinsko pravo in pravne storitve, ki se nanašajo na družinske zadeve.
Uporaba UI v pravu pa je kljub morebitnim pozitivnim vidikom povezana s številnimi etičnimi in moralnimi dilemami, katerih problematičnost se kaže tudi pri rabi UI v družinskem pravu. Družinsko pravo se namreč ukvarja z enimi izmed najbolj občutljivih vprašanj, ki zahtevajo osebni pristop in čustveno razumevanje. Prihodnost avtomatiziranih postopkov in uporaba UI v družinskem pravu imata svoje prednosti, vendar je pomembno prepoznati tudi morebitne izive in omejitve, zlasti glede varstva zasebnosti in osebnih podatkov.

In today's digital and technologically advanced world, artificial intelligence (AI) is increasingly asserting itself as a crucial factor affecting many areas of human activity. One of the industries facing the arrival of AI is also law. Family law, as one of the branches of law, is not protected before the arrival of artificial intelligence.
In my master's thesis, I will focus on exploring the impact of AI on family law and examining how UI is included in legal procedures and services related to family matters. Abroad, it is already possible to see the development of applications that use UI, especially in the Unated States of America (USA), Australia, Canada and the Netherlands. These apps use UI algorithms to streamline processes and give clients easier and more affordable access to legal services, while relieving the burden on lawyers. Studying different models of UI use abroad will give us insight into different models of UI use and their impact on legal services related to family matters.
The use of AI in law is, despite possible positive aspect, connected with many ethical and moral dilemmas, the problematic nature of which is also evident in the use of AI in family law. Family law deals with some of the most sensitive issues that require a personal approach and emotional understanding. While the future of automated procedures and the use of AI in family law offers advantages, it is also important to recognize potential challenges and limitations, especially regarding the protection of privacy and personal data. |
