Abstract
Pravna načela predstavljajo temelje EU, saj zagotavljajo trden okvir, ki ureja njene institucije, države članice in državljane ter so njen najpomembnejši pravni vir. Njihova vloga se odraža skozi poenotenje zakonodaje, zapolnjevanje vrzeli ter dajanje teži in legitimnosti pravnemu redu EU kot celoti ter so ključnega pomena za delovanje EU. Njihov pomen je v pravnem redu EU že dolgo časa nedvomen, pri usmerjanju uporabe ter razlage pravil evropskega prava pa neizogiben. Uresničevanje pravnih načel poteka z uporabo prava, predvsem s sodno prakso Sodišča EU. EU se opira na sklop pravnih načel, da bi zagotovila doslednost, pravičnost in varstvo temeljnih pravic v državah članicah. Ko postanejo regulirani pojavi kompleksnejši, načela pogosto zagotavljajo večjo doslednost kot pravila, saj lahko ponavljajoče prizadevanje za natančnost v posameznih pravilih povečuje nenatančnost kompleksnega sistema pravil. Doslednost na kompleksnih področjih je tako možno bolje uresničiti z ustrezno kombinacijo pravil in načel kot pa samo z uporabo načel. Eden od razlogov za to, da ima pravo EU toliko splošnih načel in da imajo ta načela tako pomembno vlogo, je, da Pogodbe v številnih točkah določajo le zelo omejen in odprt okvir. Kot bomo videli, je bil ta omejen okvir osredotočen predvsem na gospodarsko povezovanje, manj pa na druga pravna vprašanja, kot so temeljne pravice. Zato je bila pogosto naloga Sodišča EU, da dopolni splošni okvir, po potrebi zagotovi varstvo in na splošno vdihne življenje samim temeljem Pogodb. Načela so temeljni gradniki, ki zagotavljajo usklajenost ter integriteto pravnega reda EU ter prispevajo k celovitosti in funkcionalnosti pravnega sistema EU. Pravna načela prispevajo k postopkovni pravičnosti pri odločanju v EU. Prispevek te magistrske naloge se kaže v tem, da temeljito in podrobno predstavi pravna načela ter njihov pomen najprej skozi zgodovinski razvoj načel ter nato v luči njihove vloge in funkcije v pravnem redu EU in v njihovem odnosu do načel mednarodnega prava. Pravna načela so predstavljena sistematično ter celovito.

Legal principles and their importance in EU law |

Legal principles are the foundations of the EU, providing a solid framework that governs its institutions, its Member States and its citizens, therefore they are the most important source of the Union law. Their role is reflected in the unification of law, filling gaps and lending weight and legitimacy to the EU legal order as a whole, and they are crucial to the functioning of the EU. Their importance has long been unambiguous in the EU legal order, and they are inevitable in guiding the application and interpretation of the rules of European law. Legal principles are implemented through the application of the law, in particular the case law of the Court of Justice of the EU. The EU relies on a set of legal principles to ensure consistency, fairness and the protection of fundamental rights in the Member States. As regulated phenomena become more complex, principles provide more consistency than rules, as the repeated pursuit of precision in individual rules has the potential to increase the imprecision of a complex system of rules. Consistency in complex areas can thus be better achieved through an appropriate combination of rules and principles than through the application of principles alone. One of the reasons why EU law has so many general principles, and why these principles play such an important role, is that the Treaties provide only a very limited and open framework on a number of points. As we shall see, this limited framework has focused mainly on economic integration and less on other legal issues such as fundamental rights. It has therefore often been the role of the Court of Justice of the European Union to complement the general framework, to provide protection where necessary and, more generally, to breathe life into the very foundations of the Treaties. Principles are the fundamental building blocks that ensure the coherence and integrity of the EU acquis and contribute to the integrity and functionality of the EU legal system. Legal principles contribute to procedural fairness in EU decision-making. The contribution of this Master's thesis is to present in depth and in detail the legal principles and their meaning, first through the historical development of the principles and then in the light of their role and function in the EU legal order and in their relation to the principles of international law. The legal principles are presented in a systematic and comprehensive manner. |
