Abstract
Diplomska naloga obravnava redefinicijo posilstva kot kaznivega dejanja, in sicer s
poudarkom na jasnosti soglasja med spolnimi partnerji. Naloga raziskuje različne pristope
k redefiniciji posilstva v različnih državah, kot so Švedska, Nemčija, Francija, Velika Britanija
in Španija. Pri tem proučuje, kako se zakonodaja spreminja, da bi bolje zaščitila žrtve in
določila jasno soglasje kot ključni element spolnega dejanja. Naloga analizira tudi psihične
in fizične posledice posilstva ter raziskuje obstoječe organizacije in ustanove v Evropi, ki
nudijo pomoč žrtvam posilstva. Prav tako se diplomska naloga osredotoča na potrebo po
redefiniciji posilstva kot kaznivega dejanja in razloge za to, pri čemer poudarja pomen
zagotavljanja jasnega soglasja v spolnih odnosih. V navezavi na to izpostavlja predloge za
redefinicijo in raziskuje, kako bi takšne spremembe lahko izboljšale zaščito žrtev in
zmanjšale pojavnost spolnega nasilja. Diplomska naloga na osnovi analize različnih
pristopov k redefiniciji posilstva kot kaznivega dejanja omogoča vpogled v pomembno
družbeno vprašanje, ki se nenehno razvija, da bi bolje odražalo sodobne norme in vrednote
glede soglasja med spolnimi partnerji.

Secondary abstract: |
The thesis deals with the important topic of redefining the crime of rape, focusing on the
clarity of consent between sexual partners. The thesis explores the different approaches to
redefining the crime of rape in different countries such as Sweden, Germany, France, the UK
and Spain. Consideration is being given to how legislation is being changed to better protect
victims and to make clear consent a key element.
It also analyses the psychological and physical consequences of rape and explores existing
organisations and institutions in Europe that provide support to rape victims. These include
organisations such as La Maison des Femmes in France and Women Against Violence in
Europe (WAVE). In addition, the thesis focuses on the need to redefine the crime of rape
and the reasons for this, emphasising the importance of ensuring clear consent in sexual
relationships. It also offers suggestions for redefining the offence and explores how such
changes could improve victim protection and reduce the incidence of sexual violence.
Together with an analysis of different approaches to redefining the crime of rape, the thesis
offers insights into an important social issue that is constantly evolving to better reflect
contemporary norms and values regarding consent between sexual partners. |
