Primerjava pritožbenega postopka v Sloveniji in drugih državah

Abstract

Pritožbeni postopek na delo policije je ključni mehanizem za zagotavljanje pravičnosti in korektnosti delovanja policijskih organov ter spoštovanja človekovih pravic in temeljnih svoboščin. Državljanom omogoča, da izrazijo svoje pomisleke oziroma nestrinjanje z ravnanjem policije, kar je ključnega pomena za ohranjanje pravne države in zaupanja javnosti v delovanje policijskih sil. Določen je z zakonodajo, ki opisuje kako naj posamezniki vložijo pritožbo, kako se ta obravnava in kako se sprejemajo končne odločitve. Pritožbeni razlogi so različni in zajemajo različne vrste nepravilnosti, kot so neupravičena ali prekomerna uporaba sile, diskriminatorno obnašanje policistov, zloraba policijskih pooblastil ali druge oblike neustreznega ravnanja. Postopki pritožb se razlikujejo od države do države. V Sloveniji imamo na primer dvostopenjski postopek reševanja pritožb, tekom izdelave diplomske naloge pa smo predstavili še postopke drugih držav, med katerimi so nekateri podobni slovenskemu, nekateri pa se od našega sistema tudi precej razlikujejo. Diplomska naloga torej obravnava in primerja postopke reševanja pritožb na delo policije v Sloveniji in nekaterih drugih državah. Poleg tega opiše zgodovinski razvoj pritožbenega sistema v Sloveniji, od obdobja pred osamosvojitvijo do sodobne ureditve. Opiše trenutno ureditev pritožbenega postopka pri čemer opredeli vsebino in udeležence postopka, različne načine reševanja pritožbe in ukrepe zoper policiste, ter poda statistični pregled pritožb v zadnjih letih. Naloga izpostavlja pomen transparentnosti, neodvisnosti in nepristranskosti v pritožbenem postopku, ki so ključni za vzdrževanje pravne države in zaupanje javnosti v delovanje policijskih organov. Zaključno delo tako lahko služi kot podrobna analiza, ki lahko pripomore k boljšemu razumevanju pritožbenega postopka v Republiki Sloveniji in nekaterih drugih evropskih državah in razmišljanju o morebitnih izboljšavah v prihodnosti.

Secondary abstract:	The police complaints procedure is a crucial mechanism for ensuring justice and proper functioning of police authorities, as well as the respect for human rights and fundamental freedoms. It allows citizens to express their concerns or disagreements with police conduct, which is essential for maintaining the rule of law and public trust in the operations of police forces. The complaint procedure is defined by legislation, which describes how individuals can file a complaint, how it is processed, and how final decisions are made. The reasons for complaints are varied and include different types of irregularities, such as unjustified or excessive use of force, discriminatory behavior by police officers, abuse of police powers, or other forms of improper conduct. Complaint procedures vary from country to country. For instance, in Slovenia, we have a two-tier process for resolving complaints, and during the course of preparing the thesis, we also presented the procedures of other countries, some of which are similar to the Slovenian system, while others differ significantly from our system. The thesis therefore addresses and compares the procedures for resolving complaints against police work in Slovenia and some other countries. Additionally, it describes the historical development of the complaints system in Slovenia, from the period before independence to the modern arrangement. It describes the current arrangement of the complaint procedure, defining the content and participants in the process, different ways of resolving the complaint and measures against police officers, and provides a statistical overview of complaints in recent years. The thesis highlights the importance of transparency, independence, and impartiality in the complaint procedure, which are crucial for maintaining the rule of law and public trust in the functioning of police authorities. The final work thus serves as a detailed analysis that can contribute to a better understanding of the complaint procedure in the Republic of Slovenia and some other European countries and to considerations of possible improvements in the future.
