Abstract

Javno-zasebna partnerstva, ki so opredeljena kot dolgoročne pogodbe med javnim in zasebnim sektorjem, v zadnjih letih naraščajo v pomenu. Ključna vloga teh partnerstev je zagotavljanje javnih dobrin in storitev, pri čemer zasebni partner prevzame pomemben delež tveganja in odgovornosti za njihovo učinkovito upravljanje. JZP se uveljavijo kot inovativno politično orodje, katerega uspešna implementacija prinaša koristi tako za javni kot zasebni sektor, predvsem pa za končne uporabnike, za katere je posamezen projekt zasnovan. Diplomska naloga je razdeljena na teoretični in analitični del. V teoretičnem delu so predstavljene osnovne značilnosti in sestavine JZP, kot tudi tveganja, ki jih ti projekti prinašajo. Obravnavane so prednosti in slabosti teh partnerstev, prav tako pa so izpostavljene priložnosti in nevarnosti, ki se lahko pojavijo med njihovim izvajanjem. Ker se projekti JZP lahko izvajajo na podlagi dveh različnih pravnih okvirov – pogodbenega in statusnega partnerstva – so v nalogi natančno opredeljene njihove značilnosti. V analitičnem delu naloge je izvedena analiza področja JZP v Evropi, kjer so obravnavani projekti med letoma 2010 in 2023, z osredotočenostjo na število izvedenih projektov po državah in sektorjih. Na koncu so predstavljeni tudi izbrani primeri projektov, v katerih je bila uporabljena pogodba JZP.

Secondary abstract: Public-private partnerships, defined as long-term contracts between the public and private sectors, have been growing in importance in recent years. The key role of these partnerships is to provide public goods and services, with the private partner assuming a significant share of the risk and responsibility for their effective management. PPPs are emerging as an innovative policy tool whose successful implementation brings benefits to both the public and private sectors and, above all, to the end-users for whom each project is designed. The thesis is divided into a theoretical and an analytical part. The theoretical part presents the basic characteristics and components of PPPs, as well as the risks these projects bring. It discusses the advantages and disadvantages of these partnerships, while also highlighting the opportunities and threats that may arise during their implementation. Since PPP projects can be carried out based on two different legal frameworks – contractual and status-based partnership – the thesis provides a detailed definition of their characteristics. The analytical part of the thesis presents an analysis of the PPP field in Europe, focusing on projects between 2010 and 2023, with an emphasis on the number of projects implemented by country and sector. Selected examples of projects using PPP contracts are also presented at the end.
