Secondary title: Research on the role of municipalities by land consolidation in Slovenia and comparative analysis with Bavaria
Secondary abstract: In the thesis, the role of municipalities by land consolidation in Slovenia is studied and a comparative analysis of land consolidation process between Slovenia and Bavaria is presented. In the first part, international guidelines in the field of land consolidation are given, exposing land consolidation as an instrument for rural development. In Slovenia, the municipality usually has two main tasks considering land consolidation, namely project preparation and help by its financing. Furthermore, an important role of the municipality is providing assistance for implementation of agromelioration. For the purpose of our study, a survey has been conducted among Slovenian municipalities, wherein over 100 municipalities have participated. The majority of municipalities are highly interested in getting more information on land consolidation due to their mostly poor knowledge on this procedure. In the last fifteen years, only a third of the participating municipalities received an initiative for land consolidation, whereby merely in 21 municipalities those procedures have actually been carried out. The main two reasons for failure of land consolidation initiatives are landowners’ disapproval and the fact that land consolidations had not beforehand been foreseen in the municipal spatial plan. Municipalities experienced in land consolidation have exposed the problems they face by preparation of the necessary documentation, financing, lengthy appeals procedures and land valuation. In the second part of the thesis, the good practices in Bavaria are presented. It has to be emphasized, that land consolidation there is an instrument for holistic development of the countryside, whereby all inhabitants, not only the landowners, are actively involved and educated about land consolidation; the local inhabitants are therefore important actors at shaping development plans and their actual implementation in the countryside. Professional assistance is systematically provided by inter-municipal regional public offices for rural development, which are also responsible for projects’ operational aspects. In Bavarian legislation different land consolidation processes are known – all of them are supposed to be an integrated part of holistic sustainable rural development. Based on the international guidelines and Bavarian practice several suggestions for changes of land consolidation in Slovenia are given in the conclusion.

Abstract (ePrints): V diplomski nalogi smo preučili vlogo občine pri izvajanju upravnih komasacij v Sloveniji in izvedli primerjalno analizo z Bavarsko. V prvem delu naloge so predstavljene mednarodne smernice komasacij kot možnega instrumenta za razvoj in celovito urejanje podeželja. Slovenske občine imajo pri komasacijah v praksi največkrat dve osrednji nalogi in sicer priprave za uvedbo postopka ter pomoč pri financiranju komasacije. Pomembna dodatna naloga občin je podpora izvedbi potrebnih agromelioracijskih del. Na anketo, ki smo jo izvedli med slovenskimi občinami, se je odzvalo preko 100 občin. Te so v splošnem pokazale visoko zanimanje za dodatne informacije o komasacijah, saj jih večina pozna postopek le približno. V zadnjih 15-ih letih so pobudo za komasacijo prejeli v tretjini anketiranih občin, a je do dejanske izvedbe prišlo le v 21-ih občinah. Izstopajoča razloga, zakaj se komasacije na pobudo niso izvedle, sta nestrinjanje lastnikov in v OPN-ju nepredvideno območje za komasacijo. Občine, ki imajo izkušnje s komasacijami, so izpostavile probleme pri urejanju potrebne dokumentacije, pridobivanju sredstev, dolgotrajnem reševanju pritožb in vrednotenju zemljišč. Drugi del naloge je namenjen predstavitvi dobre prakse na Bavarskem. Izpostaviti velja, da so tam komasacije instrument celovitega urejanja prostora, kjer se aktivno vključujejo in izobražujejo vsi krajani in ne le lastniki kmetijskih zemljišč. Vsi prebivalci sodelujejo pri postopkih oblikovanja idejne zasnove in pri izvedbi ureditve podeželskega prostora. Strokovno pomoč jim nudijo uradi za razvoj podeželja – javne medobčinske regionalne službe, ki izvajajo tudi vsa operativna dela. Bavarska zakonodaja opredeljuje več vrst postopkov komasacij in jih smatra kot celovit instrument za zagotavljanje trajnostnega razvoja podeželja. Na podlagi mednarodnih dokumentov in bavarske prakse so v diplomski nalogi prikazane smernice nadaljnjega razvoja postopka komasacij v Sloveniji.
