Abstract

Diplomsko delo Pravni položaj delavcev v primeru outsourcinga predstavlja kakšne so posledice za osebe, ki so do tedaj sodelovale v delovnem procesu delodajalca, ki se je odločil, da pogodbeno prepusti opravljanje določenih svojih dejavnosti zunanjim izvajalcem. V prvem delu diplomskega dela sem se tako osredotočil na položaj in zakonsko ureditev delavcev ter delovnega razmerja in obsega pravic, ki jim iz tega naslova pripada, saj sem v diplomskem delu skušal prikazati kakšen pa je pravni položaj oseb, ki za drugega opravljajo delo, v primeru outsourcinga in njihovo razmerje do delavcev. Tako sem v diplomskem delu izpostavil primer outsourcinga, katerega predstavljajo primeri pogodbenega prenosa dejavnosti samozaposlenim osebam, ki so za delodajalca opravljale delo v delovnem razmerju, nato pa se je delodajalec odločil, da bo z njimi le še pogodbeno sodeloval na podlagi civilnopravnih pogodb, zato so te bile primorane formalno vzpostaviti status samozaposlene osebe. Opredelil sem se do problematike t.i. navidezne samozaposlitve ter novega instituta v naši zakonodaji – ekonomsko odvisnih oseb. Na koncu sem se še osredotočil na vlogo inšpekcije za delo, ki lahko predstavlja močan mehanizem v boju proti zlorabam instituta samozaposlenih oseb, predvsem v sankcioniranju poslovnih praks, kjer delo opravlja v razmerjih navidezne samozaposlitve.

Secondary abstract: The thesis Legal status of workers in case of outsourcing introduces the consequences for employees who were formerly participating in the working process of the employer, who decided to contract-out some of his non-core business to outside contractors. Firstly I have focused on the legalisation and legal position of employees, the definition and elements of employment relationship and the (legal) rights of employees. I discussed and compared the legal positions of employees with other persons, who are working for employer in the dependant relationships in the spirit of outsourcing and tried to show some differences in their legal positions. Following that, I discussed self-employed persons, who were formerly in the employment relationship with their »employer«, until they decided, they will no longer have them in the working process, but would contract-out certain activity to those former employees, who became self-employed. This example raises two sub-categories of self-employed persons. First is the economically dependent workers, which is a new category in our law system and secondly the so called bogus self-employed persons, who are actually workers. In the last section I’ve primarily focused on the role of the Labour inspection, which presents a strong mechanism in fight against exploitations on behalf of the self-employed persons, where the trend of bogus self-employment is on the rise. This has caused numerous sanctions carried out by the labour inspection to prevent such way of illegal business practice.
