Abstract
V Republiki Sloveniji se v zadnjih letih povečuje problematika zaradi kršitev javnega reda in ogrožanja varnosti posameznih navijaških skupin na športnih prireditvah, zlasti na nogometnih tekmah. Kljub povečani aktivnosti tako policije kot tudi pristojnih inšpekcijskih organov občasno prihaja do hudih izgredov, zato je upravičeno sprejemanje dodatnih zakonskih ukrepov za zagotavljanje varnosti na športnih prireditvah. Čeprav v družbi obstaja zavedanje, da samo z represivnimi oziroma policijskimi ukrepi ni možno doseči celovitega namena, ki izhaja iz evropske konvencije o nasilju in nedostojnem vedenju obiskovalcev na športnih prireditvah, zlasti na nogometnih tekmah, pa je ob vse večjih športnih objektih in hkrati popularizaciji športa v Republiki Sloveniji treba učinkovito ukrepati zoper tiste nasilne obiskovalce, ki športne dogodke zlorabljajo za nasilne izgrede. Predvsem z vidika enega najpomembnejših načel zakonitosti je pomembno, da so na enem mestu (prej v Zakonu o policiji (ZPol, 1998) in v več podzakonskih aktih) sistematično in celovito urejene ter določene policijske naloge in splošna policijska pooblastila, vključno s prisilnimi sredstvi. Večina policijskih pooblastil in policijskih nalog je v Zakon o nalogah in pooblastilih policije (ZNPPol, 2013) prenesena iz podzakonskih predpisov. To pomeni, da se posamezni standardi iz določb pravilnikov vnašajo v sam zakon zaradi pomembnosti in globine posega posameznih policijskih pooblastil v svoboščine in pravice oseb. S tem se posledično zmanjšujejo podzakonski predpisi.
Novo policijsko pooblastilo »prepoved udeležbe na športnih prireditvah« na nedvoumen in jasen način sporoča obiskovalcem športnih prireditev, da jim bo v določenih primerih zaradi prekrškov ali kaznivih dejanj lahko izrečen ukrep prepoved udeležbe na športnih prireditvah. Z uzakonitvijo te prepovedi družba povsem jasno izraža zavezo o ničelni tolerantnosti do nasilja.

In recent years there is an increasing problem in Republic of Slovenia about violation of public law and order and endangering safety of individual cheerleader groups at sport events, especially at football games. Despite the increased activity of police and competent inspection authorities there are still serious disturbances occasionally so it is still justified to take further legal actions to ensure safety at sporting events. Although there is still awareness in public that just with repressive police actions there is no way to ensure the safety on those kind of events which comes out of European convention of violence and inappropriate behavior of visitors on sports events. Especially on football games where are sports objects getting bigger every year and there is a huge popularization of sport in Republic of Slovenia we have to prevent against violence visitors who are using sports events for violence riots. It is important under the law that we have systematically arranged and defined police duties and powers including with reprimanded assets. Most of the police powers and duties in Law of duties and police authorization (ZNPPol, 2013) is taken out of implementing regulations. That means that the individual standards are putted into the law because of importance and depth of police authorization in the rights of the person. This consequently reduces the implementing regulations.
New police authorization "the prohibition of participation in sporting events" describes in a clear and unambiguous way of communicating to visitors of sporting events that they can get a ban on participation on sports events in case of offense and violation the law. By enacting this prohibition company clearly reflects a commitment to zero tolerance of violence. |
