Abstract

V diplomskem delu je obravnavana fikcija vročitve v pravdnem postopku po pravilih slovenskega prava in prava EU. Gre za institut, ki bistveno pripomore k učinkovitosti pravdnega postopka, vendar zaradi posega v procesne pravice predstavlja relativno problematično tematiko. V nalogi je predstavljena načelna podlaga za ureditev vročanja, nadalje pa so obravnavana slovenska pravila in pravila EU o vročanju nasploh. Nato se delo ukvarja s fikcijo vročitve, kot je urejena v Zakonu o pravdnem postopku in Uredbi 1393/2007 o vročanju ter osvetli najbolj bistveno problematiko uporabe te fikcije. Bralec tega dela lahko spozna pomembnost vročanja v pravdnem postopku in se seznani s slovenskimi pravili ter pravili EU, po katerih poteka vročanje, se seznani z ureditvijo fikcije vročitve in spozna dva najbolj problematična primera uporabe obravnavanega instituta, skozi navajanje literature in pravnih virov pa je vseskozi spodbujan, da se sam loti poglobljenega študija katerega izmed posameznih aspektov fikcije vročitve in vročanja nasploh.

Secondary abstract: This degree considers ficticious service in civil proceedings under the rules of Slovenian law and European Union law. Ficticious service contributes significantly to the effectiveness of civil procedure, but is relatively problematic due to the interference with the procedural rights. First, this degree presents the base principle for the regulation of service. Second, Slovenian and European rules of the service in general are discussed. Third, it deals with ficticious service under the Civil Procedure Act and Regulation 1393/2007 and highlights the most significant issues of this institute. The reader of this work may become aware of the importance of serving in litigation and get acquainted with Slovenian and European rules that govern service, with the regulation of ficticious service and two of the most problematic examples of the application of ficticious service. The reader is also constantly encouraged to undertake in-depth study of a particular aspect of ficticious service and service in general.
