Povzetek

Civilno procesno pravo je veja civilnega prava, ki obravnava procesna ravnanja subjektov, ki se znajdejo v sporu glede določene pravice. Temeljni zakon, ki ureja to materijo je ZPP, ki na področju civilno pravdnega postopka določa pravila postopanja v pravdi oz. kategorizira pristojnosti in naloge razdeljene med procesnimi subjekti. Ena od bistvenih faz postopka je faza dokazovanja. V njem se na podlagi predloženih dokazov, ki jih predlagajo stranke in tudi včasih sodišče po uradni dolžnosti, ugotavlja resnično dejansko stanje tako, da se spoštuje načelo pravičnosti in da je končna odločitev o sporni pravici oz. predmetu enaka resničnemu dejanskemu stanju. V diplomski nalogi bom s pomočjo strokovne literature, zakona in sodne prakse predstavil segment civilnopravdnega postopka, natančneje zavarovanje dokazov pred pravdo ali tekom pravde, pa tudi potem, ko postane odločba, s katero je postopek končan, pravnomočna, če se postopek nadaljuje z izrednimi pravnimi sredstvi, v kolikor grozi, da se določen dokaz oz. sredstvo kasneje iz kakršnihkoli razlogov ne bi mogel izvesti ali grozi bojazen, da se dokaz lahko uniči ali izgubi, kar bi imelo lahko posledico za potek pravdnega postopka. Na področju zavarovanja dokazov pa ni samo relevantna domača zakonodaja, ki določa predpostavke in procesna pravila pri uporabi tega instituta, temveč daje svoje smernice in argumentacije prav tako mednarodna skupnost, natančneje Uredba Sveta Evrope. Uredba se navezuje tudi na postopke dokazovanja, natančneje opredeljuje postopke zavarovanja dokazov, kadar se postopek v posamezni državi članici razširi na področje druge države članice in se zahteva mednarodna solidarnost in pomoč pri reševanju konkretne zadeve.

Sekundarni povzetek: Civil procedural law is a branch of civil law covering procedural practices of subjects who find themselves in a dispute regarding a certain right. The basic law covering this subject matter is the Civil Procedure Act, which defines the procedural rules in a dispute or categorizes powers and tasks distributed among the procedural subjects. One of the essential stages of the procedure is the evidence stage. During this part of the procedure clients and sometimes also the court of its own motion provide evidence, based on which the facts of the dispute are established by considering the principle of fairness and making sure the final decision of the right or subject matter at issue reflect the facts. By means of professional literature, the legislation and case law, the thesis discusses a segment of the civil procedure, specifically the preservation of evidence prior to or during the law suit as well as after the decision marking the completion of the procedure becomes final, if the procedure continues with further appeal, if a threat exists that certain evidence or means could not be presented or the evidence could be destroyed or lost, which could change the course of the civil procedure. The preservation of evidence is regulated by the relevant domestic legislation, defining the assumptions and procedural rules as well as by guidelines and argumentations provided by the international community, specifically by the regulation of the Council of Europe. The regulation applies to the process of demonstrating the evidence, defines in detail the process of preserving the evidence when the procedure within an individual member state extends to a field of another member state whereby international solidarity and assistance in resolving the case in question is required.
