Delitev nepremičnine v sodnem postopku

Abstract

Cilj oziroma namen diplomske naloge je prikazati postopek in rešitve problemov v primerih, ko med solastniki ni mogoča sporazumna delitev stvari s poudarkom na nepremičninah. Opisal bom temeljne pojme glede nepremičnine in posesti, saj je njihovo razumevanje nujno za sam opis kasnejšega postopka, prav tako pa je potrebno orisati njihov nastanek v zgodovini. V diplomskem delu bom preučil, kako se določeni instituti stvarnega prava z delitvijo nepremičnine prepletajo (hipoteka, služnost ...), in situacije oziroma rešitve, ki nastanejo pri takem prepletu. Delitev nepremičnine v sodnem postopku bo prikazana tudi skozi prizmo sodne prakse.

Secondary abstract:	The goal or the purpose of this diploma is to present a procedure and solutions in cases when there is no option to achieve an agreement regarding division of things, especially real estates. I will describe fundamental concepts about real-estate and possessory rights since the understanding of these concepts are essential for a presentation of a procedure. In the same time, I will describe a development of concepts throughout the history. Diploma will also present how certain institutes of property law are being efected on one another (mortgage, easement etc) and what kind of situations and solution are to be expected in such procedures. Division of real-estate will also be presented through a case law.
