Abstract
Etažna lastnina je posebna oblika lastnine oz. poseben institut stvarnega prava. Izhaja iz solastnine na nepremičnini. Posebnost etažne lastnine se kaže v tem, da hkrati predstavlja lastninsko pravico na posameznem delu in tudi solastninsko pravico na skupnem delu večstanovanjske stavbe.
Pri etažni lastnini je zelo pomemben vidik oblikovanja lastninske pravice, poleg tega pa tudi zemljiškoknjižni vidik in sicer vpis etažne lastnine v zemljiško knjigo. V preteklosti, predvsem v času družbene lastnine so bile razmere na nepremičninskem področju zelo neurejene. Zakonodajalec je s številnimi spremembami v veliki meri uredil to področje, vendar mu v celoti to še ni uspelo.
Namen diplomske naloge je predstaviti etažno lastnino in njeno oblikovanje ter vpisovanje v zemljiško knjigo. Oblikovanje etažne lastnine in vpis v zemljiško knjigo sta zelo pomembna z vidika pravne varnosti. Tukaj mislim predvsem varnosti pravnega položaja etažnega lastnika in pa varnost pravnega prometa z nepremičninami. V diplomski nalogi bom podrobneje predstavila pojem etažne lastnine in ureditev etažne lastnine, hkrati pa se bom skozi razlago dotaknila tudi razvoja instituta etažne lastnine. V diplomskem delu bo poudarek tudi na postopku vpisa etažne lastnine in njenega nastanka, razpolaganju ter prenehanju etažne lastnine.

Condominium is a special institute of property law. Condominium results from joint ownership of fixed property. Specialty of the institute is shown by the fact that it represents ownership right of individual part and at the same time joint ownership on the joint part of the multy-story building.
In Condominium, next to the formation of it, land register aspect of the Condominium is also important, that is registration in the land register. In history, especially at the time of public property, we can see that we still feel the consequences of unsettled conditions in the field of fixed property. Legislator tries with several legal solutions to edit the field of condominium, but has not been until today fully successful.
The purpose of graduation thesis is to present institution of condominium in our country; property law and land register aspects of this institute. Formations of condominium as well as the registration of it in the land register are two very important aspects for the security of legal situation of the condominium and also for the security of legal trade with fixed property. This thesis deals with: the concept and legal regulations of condominium, common and individual parts, formation, disposition and termination of condominium, condominium registration in the land register. |
