Abstract
Služnost je ena izmed stvarnih pravic, s katero lahko omejujemo lastninsko pravico. Služnostni upravičenec ima pravico, da uporablja tujo stvar ali izkorišča pravico, lahko pa tudi zahteva od lastnika, da opušča dejanja, ki bi jih sicer imel pravico izvrševati. Že iz rimskega prava izhaja delitev služnosti na stvarne in osebne. Stvarna služnost je ustanovljena v korist vsakokratnega lastnika gospodujoče stvari in praviloma ni časovno omejena.
Osebne služnosti, katerim je posvečen pretežen del diplomskega dela, so ustanovljene v korist točno določene osebe in so neprenosljive. Ustanovijo se lahko na nepremičninah, premičninah in pravicah. Trajajo najdlje do imetnikove smrti, v kolikor so ustanovljene v korist fizične osebe, če pa so ustanovljene v korist pravne osebe, lahko služnost traja največ trideset let. Zakon taksativno našteva tri osebne služnosti; užitek, rabo in služnost stanovanja. Razlika med posameznimi osebnimi služnostmi je v pravicah, ki pripadajo služnostnemu upravičencu, saj se razlikujejo po obsegu in vsebini upravičenj.
Užitek je najširša osebna služnost, ki lastniku prepušča samo golo lastninsko pravico, saj ostala upravičenja pripadajo užitkarju, ki ima pravico do uporabe in uživanja stvari. Raba služnostnemu upravičencu ne omogoča uživanja stvari, hkrati pa izvrševanja rabe ni mogoče prenesti na drugo osebo. Služnost stanovanja daje pravico imetniku služnosti in njegovim družinskim članom uporabljati tuje stanovanje ali njegove dele.

Easement is one of the real rights, with which we can limit a property right. Easement holder has the right to use foreign matter or exploit its right; he/she can also demand from the owner to give up acts, which he/she would usually have the right to conduct. There is division of easement to real and personal easement since Roman law. Real easement was founded in benefit to every holder of dominant matter and is not generally time limited.
Personal easements, which most of the diploma thesis is dedicated to, are founded in benefit to specific person and are not portable. They can be founded on real estates, personal assets and rights. If they were founded in benefit to a natural person, their durability can last till holder’s death, but if they were founded in benefit to a legal person, easement can last maximum thirty years. The law comprehensively lists three personal easements: enjoyment, use and easement housing. The difference between individual personal easements is in the rights itself, which belong to easement holder, because they are distinguished by extent and matter of entitlements.
Enjoyment is the widest personal easement, which just leaves a property right to the holder, because all of the rest entitlements belong to the beneficiary. Beneficiary has the right to use and enjoy matters. The use itself does not allow for easement holder to enjoy matter; at the same time it is not possible to transfer the execution of the use to another person. Easement housing is giving the right to the easement holder and his/her family members to use foreign housing or its parts. |
