Povzetek

Ena izmed temeljnih človekovih pravic je tudi lastninska pravica, ki kljub popolnemu varstvu ni v celoti neomejena. Njena omejenost se meddrugim kaže v služnosti kot eni izmed stvarnih pravic na tuji stvari, s katero lahko »utesnjujemo« lastninsko pravico. Služnost omogoča njegovemu imetniku uporabljati tujo stvar ali od lastnika tuje stvari zahtevati, da opušča določena dejanja, ki bi jih sicer imel pravico izvrševati na svoji stvari. Temeljna delitev služnosti izvira iz rimskega prava in se je ohranila vse do današnjih dni. Poznamo dve vrsti služnosti: stvarne in osebne. Stvarne služnosti so ustanovljene v korist vsakokratnega lastnika gospodujoče nepremičnine. So časovno neomejene in prehajajo na njegove pravne naslednike skupaj z lastninsko pravico. Osebne služnosti predstavljajo predmet mojega diplomskega dela. Temeljito so predstavljene v teoretičnem delu naloge. V praktičnem delu naloge sem predstavila primere novejše sodne prakse, s katerimi sem analizirala osebne služnosti v vsakdanjih pravnih razmerjih njihovih nosilcev. Osebne služnosti so ustanovljene v korist točno določene osebe. Ustanovijo se lahko na nepremičninah, premičninah in pravicah. So časovno omejene: v primeru njihove ustanovitve v korist fizične osebe lahko trajajo najdlje do smrti služnostnega upravičenca; če so ustanovljene v korist pravne osebe, lahko trajajo največ trideset let. Število osebnih služnosti je omejeno in se delijo na užitek, služnost rabe in služnost stanovanja. Med seboj se razlikujejo po vsebini in obsegu upravičenj. Temeljito sem predstavila užitek kot najobsežnejšo osebno služnost. Užitek najbolj omejuje lastninsko pravico lastnika in omogoča užitkarju pravico do uporabe in uživanja tuje stvari. Užitkar sme izvrševanje užitka prenesti na drugo osebo, kar pri služnosti rabe in služnosti stanovanja ni mogoče. Služnost rabe njegovemu imetniku ne dopušča možnosti uživanja tuje stvari, ampak dopušča samo rabo. Služnost stanovanja omogoča pravico imetniku služnosti in njegovim družinskim članom uporabljati tuje stanovanje ali njegove dele.

Sekundarni povzetek: One of the fundamental human rights is also a Property right, which is despite full protection not completely boundless. Among other things, its limitation seems to be in the expression of easement as one of the real rights on foreign matter and with that we can deprive the property right. The Easement allows its Holder using a foreign matter or claiming the Owner of foreign matter to abandon certain actions, which he could otherwise have the right to practice on his own matter. The basic division of Easement is derived from Roman law and has survived till these days. We know two types of Easements: real and personal. The real Easements are set up for the benefits of each Owner of the dominant property. They have no time-limitations and are passable from one successor in title, to another one together with the property right. The personal Easements represent the subject of my diploma research. They are thoroughly represented in theoretical part of the task. In the practical part of the task I presented the examples of the recent case-law were I analyzed personal Easements in the everyday legal relationships of their Holders. Personal easements are created for the benefits of a specific person. They can be established on a real property, personal property and rights. They are bounded by time: if set up in benefits of a natural person, they can last up until the death of the entitled beneficiary; if set up in a benefit of a legal person, they can last up to thirty years. The numbers of personal Easements are limited and they are divided into Enjoyment, Use and Easement housing. They differ in terms of content and scope of entitlements. I have extensively presented the Enjoyment as the most immense personal Easement. The Enjoyment mostly restricts the Owner's property right and it makes it possible for its Holder to use and enjoy foreign matter. Beneficiary can transfer into the practice of the Enjoyment to another person, that is however not possible in the Use and the Easement housing. The Use does not allow its Holder the enjoyment of foreign matter, yet only allows it to use it. The Easement housing allows beneficiary and his family members usage of a foreign housing or its parts.
