Abstract

Promet je postal del našega vsakdana, v naše življenje se vključuje v velikem obsegu, udeleženci le te-ga smo praktično vsi, bodisi v vlogi voznikov, potnikov, kolesarjev in na vse zadnje tudi peščev. Zato je zakonska ureditev cestnoprometne varnosti nujna. V kaznovalni politiki je pomembna predvsem razmejitev kršitev na kazniva dejanja in prekrške. V diplomski nalogi podrobneje primerjalnopravno analiziram cestnoprometna kazniva v slovenski in hrvaški kazenski zakonodaji. Razvoj cestnoprometnih deliktov je kompleksen, glede na to dejstvo v diplomski nalogi kratko predstavim skupno zgodovino slovenskih in hrvaških cestnoprometnih kaznivih dejanj, in ločitev zakonodajne ureditve po osamosvojitvi obeh držav. Sledi krajša prestavitev pravnih institutov, ki so potrebni za razumevanje cestnoprometnega kazenskega prava. V nadaljevanju podrobneje predstavim vseh šest inkriminiranih cestnoprometnih kaznivih dejanj v slovenskem kazenskem zakoniku. Ta cestnoprometna kazniva dejanja so: povzročitev prometne nesreče iz malomarnosti, nevarna vožnja v cestnem prometu, ogrožanje posebnih vrst javnega prometa, ogrožanje javnega prometa z nevarnim dejanjem ali sredstvom, opustitev nadzorstva v javnem prometu in zapustitev poškodovanca v prometni nesreči brez pomoči, po primerjalnopravni metodi predstavim tudi inkriminirana cestnoprometna kazniva dejanja v hrvaškem kazenskem zakoniku, ki so opredeljene kot ogrožanje prometa z nevarnim ravnanjem ali sredstvom, ogrožanje posebnih vrst prometa, predrzna vožnja v cestnem prometu in izzivanje prometne nesreče v cestnem prometu. Zakonodajno ureditev cestnoprometnih kaznivih dejanj Slovenije in Hrvaške bom primerjala z nemško cestnoprometno kazensko zakonodajno ureditvijo.

Secondary abstract: Traffic is a part of our everyday life, either as drivers, passengers, cyclists or pedestrians. Therefore, the regulation of road safety is essential. The punitive policy is a particularly important demarcation of crimes and misdemeanors. This diploma contains a comparative analysis between road traffic crimes in the Slovenian and Croatian criminal law. The development of road traffic offenses is complex; given this fact the shared history of Slovenian and Croatian road traffic crimes and separation of the regulatory regime after the independence of both countries are introduced. Next will be a short presentation of legal concepts that is necessary for an understanding criminal road traffic law. Each of the six categories of road traffic crimes in the Slovenian Criminal Code are presented in detail. They are road traffic accidents made in negligence, dangerous driving, endangerment of special public transport, endangerment of public transport with dangerous act or tool, failure to supervise public transport and leaving injured in a traffic accident without help. The criminalization of road traffic crimes in the Croatian criminal code are presented in a comparative legal method. These are: endangerment of traffic with dangerous behavior or tool, endangerment of specific types of traffic, reckless driving in road traffic and provocations accidents on traffic road. Regulation of road traffic crimes in Slovenia and Croatia are compared with Germany regulation.
