Abstract

Pravilnik o upravljanju večstanovanjskih stavb je temeljni podzakonski predpis na področju upravljanja, obratovanja in vzdrževanja večstanovanjskih stavb. Za pravilno uporabo pravilnika, je ključno tudi poznavanje drugih podzakonskih aktov, ki urejajo določene segmente stanovanjskega področja, prek katerih se pravna pravila udejanjajo v življenju. Namen diplomske naloge je predstavitev prepletenosti zakonodaje, še zlasti podzakonskih aktov, katerih skupno vez predstavlja predmetni pravilnik ter analitična predstavitev pravilnika s komentarji vezanimi na primere iz prakse. Pravilnik, ki je bil do danes dvakrat spremenjen in dopolnjen, se vsekakor prilagaja tako življenjskim kot tehničnim inovacijam in zasleduje cilj doseganja čim širšega konsenza pri končnih uporabnikih. Vseh odgovorov na medsosedska vprašanja pravilnik nima, je pa v pretežnem delu uredil in poenotil načine za obračun stroškov, ki so pred tem temeljili na dogovorih v pogodbah o medsebojnih razmerjih oz. neposredno na Stanovanjskem zakonu oz. Stvarnopravnem zakoniku. Slednje je v praksi dostikrat povzročalo slabo voljo pri uporabnikih, zaradi očitnih stroškovnih nesorazmerij. Kljub temu, da so že po sami naravi stvari interesi uporabnikov stanovanj različni, je pravilnik v življenje vnesel določen red, ki je bil prej v domeni etažnih lastnikov, pri tem pa so v glavnem prevladovali interesi lastnikov večjih stanovanj, zaradi večje pravice pri odločanju. Pravilnik o upravljanju večstanovanjskih stavb je podrobneje predpisal vse tiste temeljne vsebine, ki so nujno potrebne za neko normalno sožitje v večstanovanjski skupnosti. Poleg tega je natančneje opredelil določene vsebine, ki so bile prej nedorečene, kar je povzročalo dvome pri interpretaciji in zmedo pri etažnih lastnikih.

Secondary abstract: Rules on management of multiple dwellings is the basic implementing regulation act in the domain of management, operating and maintenance of multi-dwelling buildings under divided co-ownership. Knowledge of other housing regulations is necessary for the correct practical application of the Rules. The purpose of this thesis is representation of the intertwinement of the implementing regulations and legislation concerning Rules on management of multiple dwellings and its analytical presentation with commentary based on practical application. Up to now the Rules have been revised and supplemented twice and are adjusted to practical and technical housing innovations, and pursuing the aim of wide recognition by users. The Rules can't regulate all the issues, but still they have managed to unify methods of cost settlements, which previously based on Agreements on mutual relations among apartment owners, Housing Act and Law of Property Code. Before the Rules on management of multiple dwellings entered into force, cost settlements were defined by general legislation, such as the Housing Act and the Law of Property Code, but because of its final disproportionate division, the legitimacy of division was not well accepted by the users. Interests in multi dwelling apartment buildings are very different. When cost settlements were agreed on general bases, the intern rules of individual building could differ from building to building, yet concerning the same issues. The reason for that was the greater power in decision making of co-owners with bigger apartments. Rules on management of multiple dwellings have defined all the basic issues, necessary for the everyday coexistence in multiple dwellings. It defined precisely the costs distribution as well as other issues that before left doubts by the divided co-owners because of unsettled terms and interpretations.
