Abstract

V letu 2003 je bil sprejet novi Stvarnopravni zakonik, ki je v svoje vrste vključil tudi priposestvovanje in ga v primerjavi s predhodnikom Zakonom o temeljnih lastninsko pravnih razmerjih povsem osvežil in spremenil ter zaostril (sodna praksa je namreč široko dopuščala priposestvovanje lastninske pravice na nepremičninah, novejša sodna praksa stremi k strožjemu pristopu vrednotenja predpostavk priposestvovanja) možnosti pridobitve lastninske pravice na podlagi priposestvovanja. Priposestvovanje kot originaren način pridobitve lastninske pravice ima svojo pravna podlago v zakonu, gre za primere, ko posestnik v dobri veri poseduje določeno premičnino ali nepremičnino dalj časa kot svojo, oziroma je v opravičljivi zmoti, da je na stvari pridobil lastninsko pravico. Uvodoma sem predstavila pojme, ki so povezani s temo diplomske naloge, torej lastninsko pravico, nepremičnino ter premičnino, in ker je za priposestvovanje ključnega pomena tudi pravni temelj s katerim naj bi priposestvovalec pridobil posest, sem v kratki različici predstavila tudi pravne naslove pridobitve lastninske pravice. Sledi razjasnitev instituta priposestvovanja lastninske pravice, podrobna razčlenitev njegovih predpostavk, ki morajo biti kumulativno izpolnjeni. Ločeno je področje premičninskega in nepremičninskega pravnega urejanja. Poudarek je na priposestvovanju lastninske pravice na nepremičninah. Predstavljena so tudi dogmatska stališča nekaterih pravnikov. Stvarnopravni zakonik in Zakon o zemljiški knjigi varujeta dobrovernega tretjega, ki sklepa pravni posel z zemljiškoknjižnim lastnikom, ki pa ni dejanski lastnik. Tako je v diplomsko nalogo vključeno tudi načelo zaupanja v zemljiško knjigo, kot tudi načelo publicitete ter načelo domneve lastninske pravice. Zaradi stroge naravnanosti zakonskega urejanja priposestvovanja, ki bi lahko neustrezno rešil primere, sem zbrala in vključila novejšo sodno prakso, ki je enotnejša in vodijo pravičnim rešitvam primerov. Sodne prakse priposestvovanja lastninske pravice, ki bi začelo teči v letih veljavnosti SPZ ni bilo najti.

Secondary abstract: New Property Code was adopted in 2003, which included prescription, that completely refreshed, changed and tightened (judicial practice widely allowed prescription property rights, new judicial practice strives at stricter approach to valuation assumptions of the acquisition by prescription) the possibility of acquiring title by prescription. Prescription as an original way of acquiring title has its legal basis in the law in cases when possessor possesses a certain movable or immovable property for longer period of time as his own or is in excusable error that the ownership rights were acquired.I presented the concepts related to the topic of the thesis at the outset, namely ownership right, movable and immovable property, and because the legal foundation with which prescriptor should acquire property is crucial for prescription, I also presented in the the short version legal titles of the acquisition of property rights.Below is a clarification of the Institute of acquisition by prescription of property rights, detailed breakdown of the assumptions of this institution, which must be met cumulatively. The field of movable and real estate legal arrangement is separate. Greater emphasis is on prescription of the real estate. Dogmatic positions of some lawyers are also presented.Property Code and the Law on Land Registry protect a bona fide third party who enters into a transaction with the owner of Land Register, but is not the actual owner.Thus, the thesis also incorporates the principle of trust in the Land Register, as well as the principle of publicity and the principle of the presumption of ownership rights.Due to the strict stance of legal regulation of the prescription, which could improperly resolved cases, I collected and included recent legal practice, which is more uniform and leads to just solutions of cases. It was not possible to find the cases about acquisition of the property rights by prescription that were started during after the SPZ was passed.
