Povzetek

Diplomsko delo obravnava tematiko priposestvovanja lastninske pravice in v povezavi s pregledom novejše sodne prakse daje vpogled v problematiko ugotavljanja ter presoje obstoja posameznih elementov, potrebnih da je takšno priposestvovanje tudi uspešno. Zaradi narave priposestvovanja so v uporabi še vedno določila ODZ in ZTLR, kar je opisano v začetnem delu naloge. V nadaljevanju je obravnavana narava, torej nastanek in prenehanje lastninske pravice. Zaradi dejstva, da je priposestvovanje lastninske pravice možno le na stvareh, sta tudi podrobneje opredeljena pojma premičnine in nepremičnine. Priposestvovanje prispeva k večji varnosti pravnega prometa, saj na eni strani spodbuja k večji skrbnosti izvajanja pravic posameznika ter na drugi varuje tistega, ki je brez nasprotovanja lastnika stvar v opravičljivi zmoti uporabljal kakor svojo. Za uspešno priposestvovanje lastninske pravice morajo biti izpolnjene z zakonom določene predpostavke. Prva predpostavka je dobra vera, za njeno izpolnitev pa je potrebno, da je priposestvovalec v opravičljivi zmoti glede okoliščine lastne lastninske pravice na stvari. Druga predpostavka je, da s stvarjo nekdo razpolaga, kakor da je njegova in to tudi verjame. Tretja predpostavka pa je pretek priposestvovalne dobe, kar pomeni, da mora za uspešno priposestvovanje preteči zakonsko določen čas, ki po trenutno veljavnem SPZ znaša tri leta za premičnine in deset za nepremičnine. Priposestvovalna doba, ki je pretekla že pri pravnem predniku se všteva v priposestvovalno dobo naslednjega priposestvovalca. Glede na dejstvo, da je pravni promet z nepremičninami podvržen načelu zaupanja v zemljiško knjigo, ni nenavadno, da je v nalogi obravnavano knjižno, kakor tudi izvenknjižno priposestvovanje. Tako so obravnavani razlogi za opravičljivo zmoto, ko nekdo je in takrat ko ni vpisan v zemljiški knjigi kot lastnik. V obeh primerih je priposestvovanje lastninske pravice možno. V zaključnem delu so opisane omejitve v zvezi s priposestvovanjem lastninske pravice, ki se nanašajo na javno dobro, stvari izven pravnega prometa in na varstvo tretjega, ki je v dobri veri in na podlagi zaupanja v zemljiško knjigo pridobil lastninsko pravico od zemljiškoknjižnega lastnika ter se v zemljiško knjigo tudi sam vknjižil.

Sekundarni povzetek: The present thesis tackles the topic of property right prescription and, in conjunction with a review of recent case law, provides an insight into the issues of identification and assessment of the existence of individual elements needed for such prescription to be successful. Due to the nature of the prescription, the provisions of the Austrian General Civil Code of Law and Basic Property Law Relations Act are still in use, which is described in the initial part of the thesis. The focus of the following chapters is the nature, i.e. the formation and termination, of property rights. Because of the fact that property right prescription is only possible for objects, the thesis also includes detailed definitions of the concepts of movable and immovable property. Prescription contributes to a greater safety of the legal transactions, since it encourages greater diligence regarding the implementation of individual's rights on the one hand, and on the other hand it protects the one who has, with no opposition from the owner, used an object as his own in excusable error. For a successful property right prescription, certain statutory assumptions have to be fulfilled. The first assumption is good faith. For its accomplishment it is necessary that the prescriptor is in excusable error regarding the circumstance of his property right in the object. The second assumption is that a person treats the object in question as if it is his and that this is also what he believes. The third and final assumption is the lapse of prescriptive period, meaning that a legally specified period of time has to pass for a successful prescription to be possible. In accordance with the current Law of Property Code this period equals three years for movable property and ten for immovable property. Prescriptive period that already passed with the legal predecessor is calculated into the prescriptive period of the next prescriptor. Regarding the fact that legal transactions with immovable property are subject to the principle of trust in the Land Registry, it is not unusual for the tabular as well as contratabular prescription to be dealt with in the thesis. Thus, grounds for excusable error, when someone is and when he isn't entered in the Land Registry as the owner, are considered. In both cases, the property right prescription is possible. The final part of the present thesis describes restrictions concerning the prescription of property right. The restrictions relate to the public good, objects outside the legal transactions and the protection of the third party, who has in good faith and on the basis of trust in the Land Registry acquired property right from the registered owner and also entered himself in the Land Registry.
