Abstract

Diplomsko delo z naslovom Okrajno sodišče Ptuj v Kraljevini Srbov, Hrvatov in Slovencev prikazuje delovanje pravosodnega sistema, tako na kazenskem kot na civilnem področju, v obdobju neposredno po koncu prve svetovne vojne, v Kraljevini SHS ter vse do nastanka Kraljevine Jugoslavije. V obdobju med leti 1918-1929 se je na območju današnje Slovenije zvrstilo kar precej sprememb. Najpomembnejša med njimi je bila ta, da smo s prelomnim letom 1918 postali del nove politične in državne tvorbe in se za zmeraj poslovili od okov Avstro-Ogrske. Posledica novega obdobja se je pričela kazati tudi na področju prava in sodnega sistema, predvsem na področju kazenskih zadev. V praksi in ustavi uporabljeni avstrijski kazenski zakonik je dobil novega "partnerja" in sicer določila IX. in X. poglavja t. i. srbskega Kazenskega zakonika so se v obdobju Kraljevine SHS pričela uporabljati tudi pri nas. Vpliv srbske nadvlade se je pričel kazati tudi v pravni terminologiji in določitvi drugih vrst kazenskih deliktov s predrugačenimi kaznimi. Civilno pravo v tem obdobju ni doživelo velikih sprememb, saj je bil v uporabi Obči državljanski zakonik (ODZ), ki je zaradi poglobljenega in razvejanega vpogleda v civilne zadeve še danes posredni vir in nepogrešljiv dokument pri preučevanju civilnega prava. V sodni praksi Okrožnega sodišča Ptuj se so se tako med leti 1918-1929 v kazenskih zadevah uporabljala določila že prej uveljavljenega avstrijskega Kazenskega zakonika z novimi uveljavitvami in dopolnitvami s srbskim kazenskim sistemom. Na civilnosodnem področju pa so se uporabljale, z nekaterimi izjemami, v celoti določbe in zakoni iz ODZ-ja. Treba je poudariti, da je bilo tako število kazenskih deliktov kot civilnih obravnav sorazmerno veliko, kar gre pripisati travmatičnim povojnim letom in nastanku družbene, politične, moralne in tudi psihološke krize.

Secondary abstract: The thesis entitled District Court Ptuj in the Kingdom of SHS shows the operating of judicial system in the areas of criminal and civil law just after the World War One, in the Kingdom of SHS and until the formation of the Kingdom of Yugoslavia. Many changes took place on the territory of today's Slovenia between 1918 and 1929, the most significant being a turn point in 1918, when we became part of the new political and state structure, forever saying goodbye to the fetters of Austria-Hungary. The consequence of the new era started to show itself also in the areas of law and judicial system, mostly in the field of criminal matters. The Austrian Criminal Code, which was used in practice and in constitution, got a new "partner" - provisions from the chapters IX and X of the so-called Serbian Criminal Code came into use in the time of the Kingdom of SHS also in our country. The influence of Serbian domination started to present itself also in legal terminology and recognition of other kinds of criminal violations with altered penalties. Civil law of that time did not go through major changes, since Allgemeines Bürgerliches Gesetzbuch (ABGB) was in use. Because of its in-depth and diverse insight into civil matters, it still is an indirect source and indispensable document for civil law studies. The case law of District Court Ptuj applied to the field of criminal matters provisions from the previously established Austrian Criminal Code with new operations and completions of the Serbian criminal system between 1918 and 1929. In the area of civil proceedings, provisions and laws from ABGB were used entirely, with rare exceptions. It should be emphasized that the number of criminal violations and civil proceedings was relatively high, which should be ascribed to traumatic post-war years and the beginning of social, political, moral and also psychological crisis.
