Abstract

Poglavitni namen diplomskega dela je predstaviti institut izredne odpovedi pogodbe o zaposlitvi s strani delavca po ureditvi v Zakonu o delovnih razmerjih 1 (v nadaljevanju ZDR-1), ki je bil sprejet 13.3.2013, z začetkom veljave 12.4.2013. V diplomskem delu sem podrobneje predstavila pojem izredne odpovedi pogodbe o zaposlitvi s strani delavca, razloge za podajo te vrste odpovedi, kakšen je pravni položaj (pravice) delavca ob izredni odpovedi pogodbe o zaposlitvi, itd. S pomočjo sodne prakse sem skušala pojasniti razloge za podajo te vrste odpovedi delovnega razmerja, ter hkrati predstaviti konkretne primere in problematiko na področju izredne odpovedi s strani delavca. Obe stranki pogodbenega razmerja imata tako pri sklenitvi, kot tudi pri odpovedi pogodbe o zaposlitvi vsaka svoje pravice in dolžnosti, ki jih morata spoštovati. Odpoved pogodbe o zaposlitvi je pomemben institut na delovno pravnem področju, predvsem izredna odpoved pogodbe o zaposlitvi pa predstavlja posebno vrsto odpovedi pogodbe o zaposlitvi, saj se odnos med pogodbenima strankama tukaj še poslabša in ga v večini primerov več ni mogoče nadaljevati. Izredna odpoved delavca je mogoča le v primerih, ki jih določa ZDR-1, ter kot že navedeno, da ob upoštevanju vseh okoliščin in interesov pogodbenih strank, delovnega razmerja ni mogoče nadaljevati do izteka odpovednega roka oziroma do poteka časa, za katerega je bila sklenjena pogodba o zaposlitvi. ZDR-1 je v delovno pravno področje prinesel veliko sprememb, vključujoč s spremembami na področju izredne odpovedi pogodbe o zaposlitvi, vendar šele sodna praksa sčasoma pokaže kje se pojavlja nova problematika in katera področja bo potrebno na novo urediti.

Secondary abstract: The main purpose of this degree is to present institution of extraordinary termination of the employment contract by employee and it's arrangement in the new Employment Relationship Act (Zakon o delovnih razmerjih 1), which was adopted in April 2013. In this degree I had particulary presented the institute of extraordinary termination of the employment contract by employee, reasons in case of which employee can file extraordinary termination of the employment contract, legal position and employee's rights, etc. With help of court justice I have tried to explain the reasons in case of which employee can file extraordinary termination of the employment contract. At the same time I have tried to present this institute on actual cases and challenges at the spfere of extraordinary termination of the employment by employee. Both parties have their legal rights and obligationsthat they have to respect. The institute of extraordinary termination of the employment is very important in labour legislation. It is an particularitiy at the spfere of termination of employment contract because the relation between parties is worse then in other cases of termination of the employment and in most cases it can not be continued. Employee can file an extraordinary termination of employment contract on in case of reasons stated in the law, considering the possibility to continue employment relation until the end of contract of period of notice. The new Employment Relationship Act (ZDR-1), has brought number of changes into labour legislation, but only with time court justice will show where are new challenges and which fields will have to be reorganized.
