Povzetek

V magistrski nalogi obravnavam izredno odpoved pogodbe o zaposlitvi delodajalca v javnem sektorju, pri čemer je obravnava omejena na javne uslužbence, zaposlene pri neposrednih proračunskih porabnikih (torej v državnih organih in organih lokalnih skupnosti). Namen raziskovanja je analiza oziroma razčlenitev razlogov za izredno odpoved pogodbe o zaposlitvi delodajalca v javnem sektorju, predvsem z upoštevanjem vidika, ali je subsidiarna uporaba ZDR-1 v celoti uporabljiva za javne uslužbence. V nalogi skušam ugotoviti, ali je mogoče (vse) razloge 110. člena ZDR-1 neposredno uporabiti tudi v javnem sektorju ali pa glede uporabe navedenih razlogov v javnem sektorju obstajajo določene posebnosti oziroma so ti razlogi uporabljivi zgolj smiselno ali pa sploh niso uporabljivi. Po začetnem delu naloge, kjer so na kratko (za potrebe tega dela) orisana uslužbenska razmerja, zlasti iz vidika veljavne zakonske ureditve, so krajše predstavljeni načini prenehanja pogodbe o zaposlitvi v javnem sektorju. V jedru naloge (t. j. poglavju o izredni odpovedi pogodbe o zaposlitvi s strani delodajalca) so podrobneje, ob upoštevanju stališč različnih sodišč in sodne prakse, analizirani razlogi za izredno odpoved pogodbe o zaposlitvi, določeni v 110. členu ZDR-1. V nalogi sta izpostavljena in podrobneje obravnavana zlasti dva vidika izredne odpovedi pogodbe o zaposlitvi s strani delodajalca. Prvi vidik je postopek pravnega varstva javnih uslužbencev ter možnost izenačitve le-tega s pravnim varstvom, ki velja za delavce v zasebnem sektorju. Drugi vidik pa je analiza razlogov za izredno odpoved pogodbe o zaposlitvi delodajalca, določenih v 110. členu ZDR-1, ki se subsidiarno uporabljajo tudi za javne uslužbence, ter možnost njihove uporabe za javne uslužbence. Navedenima vidikoma sta prilagojeni dve od treh tez magistrskega dela. V primerjalnopravnem delu naloge obravnavam avstrijsko zakonodajo in njihov sistem javnih uslužbencev, s poudarkom na načinih izrednega prenehanja službenega razmerja zaposlenih v državnem javnem sektorju. Podrobneje so predstavljeni razlogi za izredno odpoved službenega razmerja avstrijskim državnim uradnikom in izvedena je primerjava le-teh z razlogi za izredno odpoved pogodbe o zaposlitvi slovenskega delodajalca v javnem sektorju. V nalogi ugotavljam tudi, ali je nezadostno delovno uspešnost, ki je po avstrijski zakonodaji razlog za izredno odpoved s strani delodajalca, mogoče primerjati s katerim izmed razlogov za izredno odpoved pogodbe o zaposlitvi delodajalca po ZJU, ali pa je takšna odpoved bolj primerljiva z razlogom nesposobnosti po 159. členu ZJU, ki je v slovenski zakonodaji razlog za redno odpoved pogodbe o zaposlitvi javnemu uslužbencu. Slednje predstavlja tretjo tezo magistrskega dela.

Sekundarni povzetek: In this master’s thesis, I discuss the extraordinary termination of the employment contract in the public sector, whereby the treatment of the topic is limited to public employees working for direct budget users (meaning in state bodies and for local community authorities). The purpose of this research is to analyse or break down the reasons for the extraordinary termination of the employment contract in the public sector, taking into account whether the subsidiary use of ZDR-1 (Employment Relationship Act) is fully applicable for public employees in particular. In the thesis, I try to determine whether (all of) the reasons from Article 110 ZDR-1 can be directly applied to the public sector as well or whether there are certain exceptions to the use of these reasons, as well as whether these reasons should be used as guidelines only or are not suitable in such cases at all. After the initial part of the thesis, where staff relations are outlined briefly, in particular in terms of the legislation in force, short descriptions of several different means of employment contract termination in the public sector are presented. In the main part of the thesis (that is, in the chapter on extraordinary termination of the employment contract), the reasons for the extraordinary termination of the contract, defined in Article 110 of ZDR-1, are analysed more thoroughly, while the perspectives of various courts and jurisprudence are taken into account. Two aspects of the extraordinary termination of the employment contract by the employer are concentrated upon and researched in more detail. The first aspect is the legal protection procedure of public employees and the possibility of matching it to the legal protection that is granted to workers in the private sector. The second aspect is the analysis of reasons for the extraordinary termination of the employee contract by the employer, defined in Article 110 of ZDR-1, that are also used for public employees, and the possibilities of their application to public employees. Two out of three hypotheses of this thesis are adapted to the two aforementioned aspects. In the comparative and legal part of the thesis I discuss Austrian legislature and their system of civil servants by putting a special emphasis on terminating the employment contract in their public sector. Moreover, reasons for the extraordinary termination of the employment contract of Austrian public employees are presented in more detail, and a comparison between their cases and Slovenian instances where the employment contract of a person working in the public sector is terminated is made as well. In the thesis I try to establish whether poor job performance, which is the reason for the extraordinary termination of the employee contract by the employer according to the Austrian legislature, could be compared to any other reason for the extraordinary termination of the employment contract according to ZJU (Civil Servants Act); or whether such a termination could be compared better to the incapability defined in Article 159 of ZJU, which presents the cause for a regular termination of the contract for public employees in Slovenian legislature. The latter presents the third hypothesis of the thesis.
