Abstract

Za izvajanje uspešno opravljenih kompleksnih preiskav posnetkov spolnih zlorab otrok je v prvi vrsti ključno mednarodno sodelovanje. To omogoča hitrejšo in uspešnejšo identifikacijo žrtev, kar je tudi končni cilj preiskave. Otroke je treba zaščititi in jim omogočiti varno nadaljnjo življenje. Pripravljenost kriminalistov za reševanje in zaščito otrok je sicer neopisljiva, vendar se soočajo tako z zakonodajnimi težavami kot tudi s pomanjkanjem kadra in finančnih sredstev, kar močno otežuje preiskave. Za hitreje izvedene postopke bi potrebovali več specifičnih forenzičnih orodij, ki bi avtomatizirano izvedla pregled fotografij in izsledkov. Glede na pričakovan porast posnetkov spolnih zlorab otrok sta v prvi meri ključna preventiva in osveščanje o tej problematiki, ki se je po besedah A. T. Klančnika (osebni intervju, 15. 7. 2015) še vedno ne zavedamo. Treba je vlagati v znanje in z ustrezno zasnovano preventivo ljudi naučiti odziva na pojav spolnih zlorab otrok. S tem se strinja tudi T. Peršuh (osebni intervju, 16. 7. 2015), ki izraža zaskrbljenost glede odkrivanj tovrstnih kaznivih dejanj, saj meni, da kriminalisti odkrijejo le vrh ledene gore oziroma tiste storilce, ki še niso tako vešči pri zakrivanju svojih sledi. V diplomskem delu so predstavljeni temeljni pojmi spolne zlorabe, posnetkov spolnih zlorab otrok in interneta. Opisujemo tudi postopke preiskovanja elektronskih naprav in pridobivanje digitalnih dokazov. Razčlenimo posamezne faze digitalne forenzike in predstavimo oteževalne okoliščine, s katerimi se preiskovalni organi soočajo tekom preiskav.

Secondary abstract: The key for the successful implementation of complex investigations of child sexual abuse material is in international cooperation. This enables faster and more effective identification of victims, which is the ultimate aim of the investigation. Children need to be protected and being enabled to live secure further life. The willingness of police investigators to deal with and to protect children is otherwise indescribable but faced both legislative problems as well as lack of staff and funding, which greatly complicates the investigation. They would need more specific forensic tools to automated carried out a review of photos and results. Given the expected increase in child sexual abuse material, the main key is prevention and raising awareness of this issue, which is, in the words of A. T. Klančnik (personal interview, 07/15/2015) still not known to us. It is necessary to invest in knowledge and with appropriately designed prevention teach people how to respond to the phenomenon of child sex abuse. T. Peršuh also agrees with that (personal interview, 07/16/2015) and he is expressing concern about the discovery of such crimes, as it considers that investigators discovered only the tip of the iceberg, or those offenders who are not yet proficient by covering their tracks. This thesis presents the basic concepts of sexual abuse, child sexual abuse material and internet. We describe the procedures of investigating electronic devices and obtaining digital evidence. We parse each stage of the digital forensics and present aggravating circumstances, which the investigating authorities faced during the investigations.
