Javna dražba v izvršilnem postopku

Abstract

Diplomska naloga obravnava javno dražbo v izvršilnem postopku. Javna dražba pomeni prodajo predmeta izvršilnega postopka tistemu ponudniku, ki na prodajnem naroku poda najvišjo ponudbo. Kot eden izmed načinov prodaje se najpogosteje izvede pri prodaji nepremičnin in premičnin. Na javni dražbi pa se lahko prodajo tudi nematerializirani vrednosti papirji, druge premoženjske oziroma materialne pravice ter delež družbenika. V diplomski nalogi so predstavljena temeljna načela izvršilnega postopka, ki veljajo za javno dražbo ter navedena sredstva izvršbe, pri katerih se opravi prodaja na javni dražbi. Podrobno je opisan potek dražbe premičnin in nepremičnin s sprotnim navajanjem sprememb, ki jih je na tem področju prinesla novela Zakona o izvršbi in zavarovanju leta 2014. Ob posameznih institutih javne dražbe pa je hkrati navedena ustrezna sodna praksa sodišč Republike Slovenije.

Secondary abstract:	The thesis presents the public auction in execution proceedings. Public auction represents the sale of an object off execution proceedings to the bidder, who has offered the highest bid. It is mostly used in the sale of movable and immovable property. Additionally, there is the possibility of selling immaterialized stocks, other material rights and associative shares. The thesis presents the fundamental principles of the execution proceedings, which are subject to public auction and stated means of execution, which is carried out at a public auction. It details the proceedings off a public auction on movable and immovable property, with a prompt inclusion of changes which have been brought to the subject by the the amendment of the Law of execution and securities from 2014. Individual institutes of a public auction are accompanied by the corresponding jurisprudence of the courts of the Republic of Slovenia.
