Povzetek

Diplomsko delo Zaznamba izvršbe in nastanek prisilne hipoteke s pregledom sodne prakse je nastalo zaradi povečanega števila izvršb te vrste v praksi. Glede na to, da se čedalje več ljudi srečuje s tem problemom in samega postopka izvršbe na nepremičnine ne pozna, sem se odločila, da dotično temo podrobneje raziščem in predstavim v diplomskem delu. Prvo poglavje vsebuje obrazložitev splošnih pojmov zaznambe izvršbe in prisilne hipoteke, ki sta primarna za nadaljnje razumevanje. Postopek izvršbe na nepremičnine je urejen z Zakonom o izvršbi in zavarovanju. Praviloma prisilna zastavna pravica nastane na dva načina, in sicer z izvršbo na nepremičnino zaradi poplačila denarne terjatve ali pa z zastavno pravico na nepremičnini v postopku zavarovanja. V diplomski nalogi sem se usmerila na področje prisilne zastavne pravice, ki nastane z izvršbo na nepremičnini, natančneje na postopek prodaje nepremičnine zaradi izterjave denarne terjatve v izvršilnem postopku. V drugem poglavju sem predstavila splošne značilnosti izvršbe in izvršilnega postopka ter predstavila tudi temeljna načela izvršbe ter nato v tretjem, četrtem in petem poglavju nadaljevala s postopkom izvršbe na obremenjeno nepremičnino ter predmeti izvršbe, zaključila pa s sredstvi izvršbe, ki so na razpolago upniku. V osrednjem delu diplomske naloge, natančneje v šestem poglavju, je predstavljen celoten potek prodaje nepremičnine v izvršbi. Ta del naloge zajema tudi postopek izdaje odredbe o prodaji in javno dražbo ter prodajo nepremičnine z neposredno pogodbo. Predstavitev postopka prodaje nepremičnine v šestem poglavju je zaključen s poglavjem, ki opisuje položitev kupnine in postopek izročitve prodane nepremičnine kupcu ter način pridobitve lastninske pravice na nepremičnini, ki je obremenjena s hipoteko. Sedmo poglavje vsebuje postopek poplačila upnikov iz izkupička od prodaje, ki se opravi po opravljeni prodaji nepremičnine na razdelitvenem naroku. V osmem poglavju sem se osredotočila predvsem na posledice, ki nastanejo s prodajo nepremičnine v izvršbi, in le-to v devetem poglavju povezala z načini prenehanja prisilne hipoteke. Teoretični del diplomskega dela sem podkrepila s primeri sodne prakse iz vsakdanjega življenja.

Sekundarni povzetek: The thesis Annotation of Enforcement and Incurrence of Forcible Mortgage with Case Law Overview resulted from an increase in the number of such enforcements in practice. Considering that an increasing number of people deal with this problem and are not familiar with the enforcement against immovable property procedures, I have decided to research the before mentioned topic in greater details and present the results in the thesis. The first chapter contains definitions of general terms, namely annotation of enforcement and forcible mortgage, which are of key importance for further understanding. The enforcement against immovable property procedure is regulated by the Claim Enforcement and Security Act. Forcible liens normally occur either because of enforcement against immovable property due to recovery of monetary claims or because of liens on immovable property in an insurance procedure. The thesis focuses on the forcible liens which arise from the enforcements against immovable property, more precisely on immovable property sales procedures which occur due to recovery of monetary claims in execution procedures. The second chapter consist of a presentation of general characteristics of the enforcement and execution procedure, as well as of basic principles of the enforcement. The third, fourth and fifth chapter deal with the execution procedure of a mortgaged immovable property, subjects to execution, as well as means of execution a creditor disposes of. The central part of the thesis, more precisely the sixth chapter, comprises a presentation of the whole sales of immovable property in execution procedure. This part also includes the making of an order procedure, public auction, and sale of an immovable property by a direct contract. The presentation of a sale of an immovable property procedure in the sixth chapter in concluded with a chapter dealing with a description of a depositing of a sale price, a delivery of immovable property to buyer, as well as with an acquisition of property rights of mortgaged immovable property procedures. The seventh chapter consists of explanation of a procedure of repayment of creditors from the proceeds of the sale, done after the sale of immovable property according to judicial sale. The eighth chapter deals with the consequences of a sale of immovable property in execution, while the ninth chapter encompasses ways of terminating a forcible mortgage. The theoretical part of this thesis is substantiated with examples of case-law from everyday life.
