Abstract

Ko oseba vstopa v delovno razmerje, se ji ponujajo različne možnosti sklepanja pogodbe o zaposlitvi. V Sloveniji to področje ureja mednarodna in nacionalna zakonodaja z Zakon o delovnih razmerjih (ZDR-1) na čelu, po katerem se klasično delovno razmerje sklepa za nedoločen čas s polnim delovnim časom. Vsi zaposleni delo opravljajo na delovnem mestu delodajalca, ki jim nudi vsa potrebna delovna sredstva in opremo. Zakon priznava tudi posebne vrste pogodb, imenovane fleksibilne oblike pogodb o zaposlitvi, ki v določenih podrobnostih odstopajo od klasične oblike. V našem diplomskem delu smo, za potrebe zaposlitve novega sodelavca v hotelu Vila Bojana na Bledu, opredelili štiri vrste pogodb, in sicer: pogodbo o zaposlitvi za določen čas in pogodbo o zaposlitvi s skrajšanim delovnim časom, kjer so zaposleni v delovnem razmerju na podlagi ZDR-1 ter pogodbo o zaposlitvi s študentsko organizacijo in pogodbo o sodelovanju s samozaposleno osebo kot civilnopravni razmerji. V teoretičnem delu diplomskega dela smo omenjene pogodbe o zaposlitvi primerjali med seboj, spoznali njihove prednosti in slabosti, v nadaljevanju pa smo na podlagi rezultatov anketnega vprašalnika, ki smo ga razdelili med zaposlene v hotelskih podjetjih v gorenjski regiji, izbrali najugodnejšo obliko zaposlitve novega sodelavca. Anketirani so bili dokaj enotni pri izbiri sodelovanja s samozaposleno osebo. Na koncu raziskovalnega dela smo primerjali še plačila prispevkov, obračune plač ter obdavčitve samostojnega podjetnika in družbe z omejeno odgovornostjo ter se s pomočjo slednje primerjave dokončno odločili za izbiro.

Secondary abstract: When a person enters into employment relationship, there is a variety of options to conclude an employment contract. In Slovenia, this area is governed by international and national legislation, with the Employment Relationships Act (ERA-1) on the forehead, according to which the classic employment relationship is to be concluded for an indefinite duration and as full-time employment. All employees carry out their working tasks at the workplace of the employer who shall provide them with the required working tools and equipment. The Act recognizes also some particular types of contracts, so-called flexible forms of employment contracts, which in some parts differ from the classic form. For the purposes of recruiting a new employee at the Villa Bojana in Bled, our thesis identifies four types of contracts, namely a fixed-term employment contract and a part-time employment contract, where employees are employed on the basis of the ERA -1 and a contract with a student organization and an agreement on cooperation with a self-employed person as a civilian law relations. In the theoretical part of the thesis, we compare the mentioned contracts of employment, we become familiar with their advantages and disadvantages, and later on, based on the results of a questionnaire, which was distributed among employees in hotel enterprises in the Gorenjska region, we choose the best form of employment for the new colleague. The interviewed persons were unanimous in their choice, which was co-operation with a self-employed person. At the end of the research part of the thesis, we deal with payment of contributions and payroll lists and compare taxation of independent entrepreneur and a limited liability company, the latter of which helped to make a final decision on which candidate to choose.
