Abstract

V diplomskem delu predstavim mednarodnopravno varstvo morja s poudarkom na predpisih, ki urejajo onesnaževanje morja z nafto. Življenjsko okolje v katerem živimo je vedno bolj onesnaženo. Zaradi tega ohranjanje in varstvo morja ni več interes posameznika, ampak postaja problem celotne mednarodne skupnosti. Težav ni mogoče rešiti le z uporabo notranjega prava držav, zato v ospredje prihajajo pomembni dvostranski in večstranski dogovori držav ter akti mednarodnih organizacij. V začetnem delu naloge natančneje opredelim pojem in pomen mednarodnega pomorskega prava ter bralca seznanim z mednarodnimi organizacijami, ki sprejemajo akte in bistveno pripomorejo k varstvu morja pred onesnaževanjem. V osrednjem delu predstavim vse najpomembnejše mednarodne instrumente, ki se nanašajo na prepoved onesnaževanja morja z nafto, varovanje človeških življenj na morju, varno upravljanje ladij, usposabljanje pomorščakov, intervencije obalnih držav na odprtem morju v primeru onesnaženja z nafto in odgovornost za onesnaženje morja z nafto. Prav tako predstavim razloge in posledice nastanka mednarodnih instrumentov, ki urejajo onesnaževanje morja z nafto s posameznimi primeri nesreč tankerjev. Na koncu diplomskega dela navedem in opišem tudi najpomembnejše enostranske pravne akte držav in predstavim sklepno razmišljanje - ali vsi navedeni predpisi zagotavljajo potrebno pravno varstvo problema onesnaževanja morja z nafto ali pa bo potrebno sprejeti še nekoliko strožje predpise.

Secondary title: International maritime protection law with emphasis on the legislation regarding pollution of the sea by oil
Secondary abstract: This diploma thesis presents international legal protection of the sea with emphasis on the rules and regulations governing sea pollution by oil. Our living environment is becoming increasingly polluted. The preservation and protection of the sea are thus no longer only in the interest of an individual but are becoming a problem of the entire international community. Problems can no longer be solved by using internal national laws and important bilateral and multilateral treaties and documents issued by international organisations are coming to the forefront. The first part of the thesis defines the term and importance of international maritime law and familiarises the reader with international organisations that adopt corresponding documents and substantially contribute to protecting the sea from pollution. The main part of the thesis focuses on the most important international instruments that relate to the prohibition of sea pollution by oil, protection of human life at sea, safe ship management, mariner training, interventions of coastal countries in open sea in the event of oil pollution, and the responsibility for sea pollution by oil. It also presents the reasons for and consequences of the occurrence of international instruments that govern sea pollution by oil with individual examples of tanker accidents. In the end, the thesis provides and describes the most important unilateral legal documents of countries and presents the conclusions – do all the listed rules and regulations provide sufficient legal protection with regard to the problem of sea pollution by oil or are stricter rules required.
