Abstract

Naloga obravnava delovnopravno zaščito žvižgača - delavca oz. javnega uslužbenca, ki na podlagi utemeljenih razlogov razkrije nezakonito, koruptivno, nepravilno ali škodljivo ravnanje delodajalca. Žvižgaču, ki na podlagi razumnih razlogov verjame v točnost razkritih obremenilnih informacij o delovanju njegove organizacije, je potrebno nuditi zaščito. Žvižgaštvo je eden izmed mehanizmov transparentnega delovanja javnega in zasebnega sektorja ter krepitve demokratične odgovornosti, poleg tega pa predstavlja temeljni vidik svobode izražanja in svobode vesti. Za uveljavitev žvižgaštva je potrebna jasna zakonodaja, ki nudi tudi učinkovito zaščito žvižgačem pred povračilnimi ukrepi delodajalca. V nalogi je na podlagi analize pravnih virov mednarodnega prava, slovenskih pravnih virov, ustrezne znanstvene in strokovne literature ter slovenske sodne prakse, najprej analizirana zaščita žvižgačev pred povračilnimi ukrepi, ki jo nudi obstoječa slovenska zakonodaja. V nadaljevanju so prikazane nekatere rešitve v drugih pravnih sistemih ter proučena pravna vprašanja, ki se nanašajo na ureditev delovnopravnega varstva žvižgačev. Na koncu naloga prinaša tudi nekatere predloge, ki bi pripomogli k učinkovitejši ureditvi področja žvižgaštva.

Secondary abstract: The thesis deals with labor law protection of a whistlebower – a worker or a public servant who has reasonable grounds to disclose the illegal, corruptive, improper or harmful conduct of the employer. Whistleblowing is one of the mechanisms for safeguarding transparent operation of the public and private sectors and strengthening of democratic accountability. Moreover, it constitutes a fundamental aspect of freedom of expression and freedom of conscience. For this reason, the protection should be provided for a person, who, based on reasonable grounds, reveals information that have broader implications for the public. Legislation that enables whistleblowing should therefore be clear and ensure effective protection against employer’s retaliation. The thesis through the analysis of international law, Slovenian legal sources, relevant scientific and technical literature as well as Slovenian jurisprudence first examines the existing legal protection of the whistleblowers in Slovenia with the emphasis on the protection from employer’s retaliation. It then presents some solutions in other legal systems and finally proposes concrete measures to strengthen the regulation and enable more effective protection of whistleblowing in Slovenia.
