Abstract
Pogodba o zaposlitvi je lahko odpovedana s strani delavca kot tudi s strani delodajalca. V kolikor je odpovedana s strani delodajalca, mora biti za to podan utemeljen razlog, ki onemogoča nadaljevanje delovnega razmerja. Zakon o delovnih razmerjih razloge taksativno določa in eden izmed njih je tudi razlog nesposobnosti. Zakon loči med subjektivnim razlogom nesposobnosti, ki je podan, če delavec ne dosega pričakovanih delovnih rezultatov in med objektivnim razlogom nesposobnosti, ki je podan, če delavec ne izpolnjuje pogojev, ki so določeni z zakonom oziroma s podzakonskimi predpisi.
Zakonske določbe o redni odpovedi pogodbe o zaposlitvi iz razloga nesposobnosti so splošne, zato imajo pri interpretaciji določb ključno vlogo sodišča. V diplomskem delu je tako ob navajanju zakonskih določb in pravne teorije upoštevana tudi novejša sodna praksa Višjega delovnega in socialnega sodišča in Vrhovnega sodišča Republike Slovenije.

THE TERMINATION OF EMPLOYMENT CONTRACTS ON GROUND OF INCAPABILITY IN THE LIGHT OF RECENT COURT CASE -LAW |
Secondary abstract: |
The employment contract concluded between the employee and the employer can be terminated by both of the contract clients. If it is terminated by the employer, a good reason that undermine the continuation of the employment relationship have to be given. One of such grounds that is specified in the Act on Employment Relations Act (ERA-1) is the ground of incapability. The law distinguishes between subjective ground of incapability which will be given if the employee will not achieve the expected operating results and the objective ground of incapability, which will be given if the worker does not fulfill the conditions laid down by law or regulations.
The provisions of the ERA-1 for regular termination of the employment contract due to ground of incapability are generic, so the Court has the key role at interpretation of provisions of the Act. In the thesis all of the statutory provisions, legal literature and the recent case law of the Higher Labour and Social Court and the Supreme Court of the Republic of Slovenia are taken into account. |
