Abstract

Diplomska naloga obsega obravnavo temeljnih načel stvarnega prava in pregled aktualne sodne prakse. Diplomsko delo je v celoti predstavljeno na način, da so na začetku posameznih poglavij teoretične razlage pojmov in načel, obrazloženim ter pojasnjenim institutom pa so nato dodani tudi primeri iz sodne prakse, tako da je čim bolj nazorno in jasno prikazano, kako se navedena pravna pravila uporabljajo v sodni praksi, torej v sodbah sodišč. Prvi del diplomske naloge temelji na osnovah. Pojasnjeni so pojmi, ki so potrebni za lažje razumevanje samega diplomskega dela. Predstavljen je tudi temeljni pravni akt, Stvarnopravni zakonik, v katerem so zapisana vsa načela stvarnega prava. Stvarnopravni zakonik predstavlja osnovo nepremičninskemu urejanju, zato so njegove navedbe izjemnega pomena za vrednotenje in razlago posameznih institutov, pravnih praznin in spornih situacij. Temeljna načela stvarnega prava so za sam stvarnopravni zakonik temeljnega pomena, saj se ravno z njihovo pomočjo lahko zgradijo najtrdnejši temelji stvarnega prava. Drugi del diplomskega dela pa je namenjen podrobni predstavitvi petih temeljnih načel stvarnega prava in njihovim ključnim vlogam v slovenski sodni praksi. Bralec tega diplomskega dela lahko spozna tako podobnosti med teorijo in sodno prakso, kot tudi različne interpretacije zakonskih določb na področju stvarnega prava.

Secondary abstract: The thesis covers discussion of fundamental principles of property law and overview of current legal practice.At the beginning of every chapter in this thesis, there is a theoretical explanation of concepts and principles, added cases of legal practice follow the explained institutes, so that it is all described thoroughly and clearly how stated law rules are used in legal practice, in court judgements. The first part of the thesis basis on foundations. We explained the concepts that are necessary for general understanding. We also introduced the fundamental legal instrument, Property Code, in which all principles of property law are written. The Property Code is a foundation for estate regulations, therefore its references are especially important for valuation and explanation of individually institutes, legal emptiness and disputable situations. Fundamental principles of property law are crucial for The Property Code because with its help we can build the strongest foundation of property law. The second part of the thesis is a detailed presentation of five fundamental principles of property law and their crucial roles in Slovene legal practice. The reader of this thesis can acknowledge the similarities between the theory and legal practice as well as the different interpretations of law provisions in property law area.
