Abstract

Diplomska naloga tematizira načine pridobitve in odvzema državljanstva v Republiki Sloveniji in Republiki Franciji. Vsaki osebi namreč pripadajo temeljne pravice in svoboščine, vendar pa vsakemu posamezniku ne pripadajo hkrati tudi državljanske pravice. Te so rezervirane za državljane, ki jih država na podlagi lastne suverenosti podeljuje svojim pripadnikom. Zakoni držav o pridobitvi in izgubi državljanstva temeljijo v glavnem na treh načelih, in sicer: ius sanguinis, ius soli in ius domicili, ter tako osebam podeljujejo državljanstvo po rodu, po kraju rojstva in v redkih primerih na temeljih prebivališča. Od osnovnih načel pa ne odstopata tudi slovenski Zakon o državljanstvu ter francoski Code civil. Na podlagi analize tozadevne zakonodaje in študije dveh primerov sem ugotavljal razlike in podobnosti med slovenskim in francoskim zakonikom. Medtem ko je francoski v primerjavi s slovenskim veliko bolj obširen glede načina pridobitve ter izgube državljanstva, pa oba zakonika stremita k načelu apatridnosti, ki tudi po mednarodnem pravu zagotavlja varnost posameznikom, da ne ostanejo brez statusa državljana.

Secondary title: Acqusition and loss of citizenship in Slovenia and France
Secondary abstract: This diploma thesis discusses methods of acquisition and loss of nationality in the Republic of Slovenia and the Republic of France. Each person is entitled to the fundamental rights and civil liberties, but at the same time each individual is not entitled to civil rights. Each state that has its own sovereignty can give civil rights to its citizens. Laws of the countries on the acquisition and loss of citizenship are principally based on three principles, namely: ius sanguinis, ius soli and ius domicili which means that a person is given citizenship either by birth, the place of birth and in rare cases by residence. Neither Slovenian Nationality Law nor French Civil Code deviate from basic principles. Based on the analysis of related legislation and the study of two cases, the differences and similarities between the Slovenian and French Code have been identified. While the French Civil Code is far more extensive in the way of acquisition and loss of nationality compared to Slovenian Nationality Law, they both aim to the principle of statelessness, which also, under international law, ensures every individual not to remain without citizenship status.
