Abstract
Stavbna pravica je pomemben institut na področju stvarnega prava. V slovenskem pravnem redu je bil realiziran leta 2003, s sprejetjem Stvarnopravnega zakonika. V predzadnjem, XI. delu zakonika, je obravnavana tematika stavbne pravice, ki določa splošne in temeljne značilnosti instituta. Stavbna pravica sodi v skupino petih stvarnih pravic, med katerimi je najpomembnejša, lastninska pravica. Pri stavbni pravici gre za omejeno stvarno pravico, ki se lahko samostojno prenaša, je časovno omejena, podedljiva, odsvojljiva, načeloma odplačna hkrati pa predstavlja tudi izvedeno pravico. Pomembnost stavbne pravice se kaže v tem, da omogoča posamezniku, bodisi fizični bodisi pravni osebi, gradnjo na zemljišču, nad ali pod zemljiščem, ki ni v njegovi lasti. To pa zaradi tega, ker ni mogoča vzpostavitev lastninske pravice, ali pa ta ni smiselna.

Superficies presents an important institute in the field of property law. Necessity of Slovene legal order to enact this institute realizes in the year 2003 with the acceptance of the Property Code (called SPZ). In the penultimate part (XI.) of SPZ, discussed issue is superficies, which lays down the general and fundamental characteristics of the institute. Superficies belongs in the group of five property rights, among which the most important the right of ownership is. Superficies is restricted subject right, which can be independently transferred, is time limited, inheritable, dismissible, fundamentally amortized, and at the same time present done right. Importance of the institute superficies enables an individual, either a natural or a legal person, the right to build on, over, or under a property which is not in his belonging. Either because ownership right cannot be established or does not make sense. |
