Abstract
Priposestvovanje je eden od pravnih načinov za pridobitev stvarnih pravic. Osnovna funkcija priposestvovanja je, da omogoči uskladitev dejanskega in formalnega stanja stvarnih pravic in s tem prispeva k večji pravni varnosti. Pridobitev stvarnih pravic s priposestvovanjem zahteva izpolnjenost določenih (zakonsko opredeljenih) pogojev: obstoj lastniške posesti, dobrovernost in pretek časa.
V diplomskem delu je obravnavan institut priposestvovanja kot temelj pridobitve lastninske pravice in služnostne pravice z vidika pravne teorije, zakonodaje in sodne prakse v Sloveniji. Posebna pozornost je namenjena vprašanju, kako učinkujejo na inštitut priposestvovanja spremenjena zakonodaja (Stvarnopravni zakonik iz 2003 in nova zakonodajna ureditev zemljiške knjige) skupaj z informatizacijo zemljiške knjige, predvsem glede na koncept izvenknjižnega priposestvovanja. Izvenknjižno priposestvovanje je pred uveljavitvijo SPZ in v razmerah neurejene zemljiške knjige sodna praksa široko dopuščala.
Pregled sodne prakse in analiza izbranih tipičnih primerov, povezanih z vprašanji dobre vere, izvenknjižnega priposestvovanja in zemljiške knjige, kažejo, da se v zadnjih letih primeri izvenknjižnega priposestvovanja v sodni praksi pojavljajo bistveno manj pogosto in so utemeljeni s posebnimi zunanjimi okoliščinami, ki onemogočajo pridobitelju lastninske pravice, pridobljene na pravnoposlovni podlagi, vpis v zemljiško knjigo. S selektivno uporabo instituta priposestvovanja kot instrumenta za formalno pravno ureditev dejanskega stanja na področju stvarnih pravic se Slovenija približuje drugim državam tradicijskega sistema stvarnega prava.

Prescription is one of the legal ways for acquisition of real rights. Basic role of prescription is to enable compliance of actual (de facto) and legal (de iure) status of real rights and thus to enhance legal certainty. Acquisition of real rights by prescription requires fulfilment of certain (pre-defined by law) conditions: existence of property possession, good faith, and duration of prescriptive period.
In diploma thesis, institutio of prescription is presented as a foundation of acquisition of property rights and easement rights in terms of law theory, legislative framework and judicial practice in Slovenia. Special attention is given to the issue of the impact on the prescription of amended legislation (Law of Propety Code from 2003 and novation of law on Land Register from 1995 onwards) together with introduction of electronic land register. In this frame, focus is on the concept of out of register prescription. Out of register prescription was widely adopted by judicial practice in Slovenia in the period prior to the implementation of Law of Property Code and in circumstances of unmanaged land register.
Review of judicial practice and analysis of selected typical cases related to the issue of good faith, out of register prescription and land register point that in recent years out- law cases of- register prescription have been appearing substantially less frequently being justified by specific conditions which prevent the owner of the property (easement) right acquired by legal transaction to execute land registration. Selective use of the institution of prescription as an instrument of harmonisation of de-facto and de-iure position in domain of real rights leads Slovenia closer to the practice of other countries of ‘traditio’ law system. |
