Abstract

V diplomskem delu je obravnavano kaznivo dejanje mučenja živali v Sloveniji. Delo je osredotočeno predvsem na slovensko pravno ureditev mučenja živali. Podrobneje so obravnavani zakoni ter pravilniki, ki urejajo to problematiko, pri katerih je še poseben poudarek na posameznih členih, ki na to neposredno vplivajo, navedeni pa so tudi mednarodni pravni akti ter pravni akti Evropske unije s tega področja, saj poleg vseh mednarodnih pogodb, slovensko zakonodajo zavezujejo tudi pravni akti Evropske unije. Navedeni so ukrepi zoper kršitelje tako po kazenski zakonodaji, kot tudi po prekrškovni. Izpostavljeni so problemi pomanjkljivosti slovenske ureditve, predstavljene pa tudi spremembe na tem področju v zadnjih letih. To vodi do spoznanja, da je Slovenija v zadnjih desetih letih izboljšala normativno ureditev področja zaščite živali. Predstavljen je nadzor nad izvajanjem zakonodaje, kako je organiziran, kdo in kako ga izvaja, ter kako bi lahko nadzor izboljšali. To nas pripelje do sklepa, da problem preprečevanja mučenja živali ni v normativni ureditvi, temveč v izvršljivosti zakonodaje. Čeprav društva za zaščito živali nimajo veliko pooblastil in pristojnosti, je predstavljena njihova pomembna vloga. Izmed množice primerov mučenja živali so izpostavljeni in podrobneje opisani nekateri najbolj odmevni primeri v slovenskih medijih v zadnjih letih, pri katerih pa je najbolj pomemben njihov epilog. Nazadnje je predstavljena ureditev varstva živali pred mučenjem v drugih evropskih državah, natančneje v Nemčiji in Avstriji, kjer je pravna ureditev na tem področju bolje dodelana, pri tem pa so navedeni predvsem zakoni, nadzorstvo nad izvajanjem zakonodaje in sankcije zoper kršitelje.

Secondary title: The criminal act of torture of animals in Slovenia
Secondary abstract: Diploma thesis deals with the criminal act of torture of animals in Slovenia. It is focused mainly on Slovenian legislation regarding torture of animals. In more detail are discussed some of the laws and policies that govern this issue and especially exposed those articles which directly manage it. Further there are also mentioned international legal acts and legal acts of the European Union from this field because Slovenian legislation is obligated to international treaties and contracts and also to legislation of European Union. The thesis states measures against the offenders so under criminal law, as well as misdemeanors. There are highlighted the problems of deficiencies Slovenian arrangements but also indicated the improvements that have been initiated in this field in the last few years. This leads to the conclusion that Slovenia has improved the legal regulation of animal protection in the last decade. It is presented how the control of implementation of legislation is regulated, by whom and how it is implemented and how it could be improved. This leads to the fact that the problem of preventing cruelty to animals is not in the legal regulation but in the enforceability of the legislation. Although animal protection organizations do not have a lot of power in their hands or jurisdiction over this field the thesis presents that they still have an important role. Despite the numerous of cases of cruelty to animals, some of the most remarkable in Slovenian media over the last few years are exposed and described in more detail. Finally, the thesis presents how some other European countries deal with protection of animals from cruelty, specifically Germany and Austria and it specially introduces the laws, control over the implementation of laws and sanctions against violators.
