Povzetek
V diplomskem delu smo obravnavali eno izmed večjih problematik v Republiki Sloveniji, to je mučenje živali in s tem povezana neustrezna zakonodaja ter kazensko sankcioniranje. Pri tem smo ugotovili, da zakonodaja na tem področju v Sloveniji obstaja, vendar je še zmeraj nedorečena in v določenih primerih, predvsem pri sankcioniranju mučiteljev, premila. V diplomskem delu smo izpostavili problem odkrivanja in prijavljanja primerov mučenja živali, ukrepanja nadzornih organov ter premile ali neprimerne kazni za mučitelje živali. Ker pristojnosti in izvajanje določb Zakona o zaščiti živali (v nadaljevanju ZZZiv) zaenkrat opravlja le Veterinarska inšpekcija Republike Slovenije (v nadaljevanju UVHVVR), stremimo k temu, da bi se tudi v Sloveniji uvedla t. i. policija za živali, ki bi imela vsa potrebna pooblastila za ukrepanje in kaznovanje mučiteljev živali in bi sodelovala z društvi ter vsemi pristojnimi organi, saj so veterinarji na tem področju preobremenjeni. Za začetek bi se morala spremeniti in izboljšati stopnja družbene odgovornosti ter odnos ljudi do živali, ki se je spreminjal skozi zgodovino, ni pa se spremenil do te mere, da bi se živali prenehalo mučiti. Prav tako bi se morale spremeniti pravna ureditev varstva živali v naši državi, ki smo jo opisali v diplomskem delu, in kazni za mučitelje živali. Opisali smo tudi nekaj primerov mučenja živali ter primerjali zakonodajo in sodno prakso s tistimi v drugih državah, tako pa prišli do nekaterih rešitev, ki bi bile primerne za vsaj delno rešitev problema mučenja živali v Sloveniji. Predvsem uvedba prepovedi imetništva živali oz. odvzema živali bi bila velik napredek pri sankcioniranju. Upamo, da se bo zakonodaja na tem področju izboljšala, predvsem pa, da bodo kazni strožje in se bo tako spremenil odnos ljudi do živali, saj so živali naši sopotniki in imajo tako kot ljudje tudi določene pravice.

The thesis deals with one of the burning issues in the Republic of Slovenia, i.e. animal cruelty, inadequate legislation and criminal sanctions. It transpired that Slovenia has legislation regulating this field, but it is incomplete and too mild in terms of criminal sanctions against abusers. The thesis thus points to the issue of detecting and reporting animal cruelty, the measures taken by control authorities, and too mild or inadequate sentences for abusers. At the moment, the Administration of the Republic of Slovenia for Food Safety, Veterinary Sector and Plant Protection is the only one responsible for implementing the measures of the Animal Protection Act. To this end, our aim is to establish "animal police" in Slovenia, which would have all the necessary powers to take measures and punish animal abusers. It would also cooperate with animal protection societies and competent bodies because veterinarians are currently overburdened with this issue. The first step should be to change and improve social responsibility and attitude of people towards animals, which has been changing throughout history, but not to the point where animals would no longer be tortured. Furthermore, the legal regulation of animal protection and sentences for abusers in our country should also be changed. The thesis describes several examples of animal cruelty and compares the regulation and case law from other countries. It also proposes certain solutions that would at least partially resolve the issue of animal cruelty in Slovenia, especially by introducing a ban on the right to hold animals and the removal of the animal, which would significantly improve sanctioning. It is our hope that the legislation in this field will improve in the future, particularly in terms of stricter sentences that would help change the attitude of people towards animals. Animals are part of our lives and as such, we share certain rights. |
