Povzetek
Namen dela je analiza trenutno uveljavljene zakonodaje s področja pravnega varstva živali in njihovih pravic ter izpostavitev njenih pomanjkljivosti. S primerjavo normativnih ureditev drugih držav smo dosegli celovit pregled prave ureditve tega področja in na podlagi tega predlagali rešitve, ki bi bile kompatibilne z našim sistemom. Z analizo dejanskih primerov smo ugotovili pogostost prekrškov in kaznivih dejanj, načine mučenja, odzive pristojnih organov in splošno mnenje prebivalstva oziroma odzive na ravnanja. Področje zaščite živali ima širok obseg, zato smo se omejili na domače živali in se bolj konkretno posvetili zlorabi in mučenju le-teh v obdobju zadnjih desetih let.
Ugotovili smo, da se je število obravnavanih zlorab mučenja živali v slovenskem prostoru v zadnjih desetih letih povečalo za 48 %, razlog tega pa je tudi nadgrajena zakonodaja, ki jo je priporočila Evropska unija, in resnejša percepcija zaščite živali. Članstvo Slovenije je torej zagotovo vplivalo na razvoj zakonodaje na področju zaščite živali in jo v določenih primerih izboljšalo, nismo pa še na stopnji Nemčije, Avstrije ali Švice. Te države imajo zelo strogo zakonodajo in verjamejo, da so vse živali čutna bitja, s katerimi je potrebno ravnati spoštljivo in dostojanstveno. Ugotovimo, da so slovenski storilci moškega spola in ne obžalujejo svojih dejanj. Zlorabo izvajajo najpogosteje samostojno nad psi. Predvidene sankcije v Sloveniji so v primerjavi z izbranimi primerljivimi državami nizke, kljub temu pa smo mnenja, da sta neformalna kontrola in vplivi javnosti najglasnejši opozorilni krik na nepravilnosti. Potrebno se je zavedati, da sprenevedanje in zanikanje ravnanj pomenita tudi njihovo tiho odobritev. Ničelna toleranca do mučenja živali pa je edina pravilna pot v boju proti zlorabam in zagotovitvi njihove dobrobiti.

The purpose of the work is to analyze the current accepted legislation in the field of legal protection of animals and their rights, as well as the exposure of its weaknesses. We have reached an overall view with the comparison of the regulations of animal protection in the other states. The comprehensive view represents the basis for proposed solutions that would be compatible with our legal system. The analysis of actual cases gathered with the open source intelligence method gave answers to our research questions. We have ascertained the frequency of offences and criminal acts, methods of torture, reactions of the responsible authorities, general public opinion and opinion of the population on the torture and cruelty on animals. Because animal protection has a wide range, we decided to limit our analysis only to domestic animals and focus specifically on torture and cruelty towards animals in the period of last ten years.
We have concluded that the number of cases of tortured animals dealt with the police in Slovenia in the past ten years has increased by 48%. We believe that one of the reasons for a larger number of criminal acts is the implementation of European Union (EU) recommendations in our legal system. With better regulations the field of research became a more seriously taken matter. Although Slovenia has implemented recommendations of EU we have not yet reached the level of Germany, Austria or Switzerland. These countries have very strict regulations and believe that animals are sentient beings that must be handled with respect and dignity. We conclude that Slovene animal abuse offenders are male and do not regret their acts. They mostly abuse dogs and by themselves independently. Our penalties against animal abusers are in comparison with other selected countries low. However we believe that the informal control and public influence is the loudest warning sign to the irregularities. We believe that pretending and denial of not knowing for the abuse gives it silent approval. Zero tolerance is the only correct way in the fight against abuse and insurance of the animals’ wellbeing. |
