Abstract

Diplomsko delo obravnava tematiko potrošniških goljufij in nepoštenih poslovnih praks ter srečevanje potrošnikov z njimi na slovenskem trgu v vsakodnevnem življenju. Zaradi vse večje konkurence med podjetji ter boja za obstanek na trgu in ob enem ustvarjati dobiček se podjetja lahko poslužujejo različnih trikov in zvijač, s katerimi največkrat mimo zakona zmanjšujejo stroške proizvodnje. Pri tem je oškodovan potrošnik, ki takšne nekvalitetne ali celo nevarne dobrine kupuje in uporablja. V ta namen smo opravili analizo domačih in tujih primarnih ter sekundarnih virov. Ugotovili smo, da je iznajdljivost tako podjetij kot posameznikov pri goljufanju praktično neomejena. Prav tako niso prevare omejene samo na določena področja kupovanja ter sklepanja pogodb ampak na potrošnika prežijo skoraj vsepovsod, pa naj bo to pri izbiri različnih dobrin v trgovinah, pri nakupovanju ali zgolj brskanju preko spleta, prav tako pa prevaranti poskušajo izrabiti potrošnikovo sočutje do sočloveka ali pa izkoristijo njegove zdravstvene težave za lasten profit. Tukaj bistveno vlogo odigra potrošnik, ki mora biti podučen in osveščen, da lažnim ponudbam ne verjame in ne nasede. Izvedli smo spletno anketo o prisotnosti potrošniških goljufij na našem trgu ter različnih vrst goljufij med slovenskimi potrošniki. Ugotovili smo, da slovenski potrošniki menijo, da niso dovolj ozaveščeni o potrošniških goljufijah in da se pogosto srečujejo z goljufijami na področju prehrane. Menijo, da v naši državi nadzor nad potrošniškimi goljufijami in nepoštenimi poslovnimi praksami ni zadosten, prav tako pa je pomanjkljiv nadzor pristojnih institucij glavni razlog, da do tovrstnih goljufij in praks sploh prihaja. Menimo, da je za preprečevanje nepoštenih poslovnih praks ter potrošniških goljufij potrebno sodelovanje med potrošniki in institucijami, pristojnimi za nadzor podjetij. Prav tako pa je zaradi odprtega in pretočnega trga potrebno sodelovanje med državami članicami Evropske unije.

Secondary title: CONSUMER FRAUD AND UNFAIR BUSINESS PRACTICES IN THE SLOVENIAN MARKET
Secondary abstract: The dissertation discusses the topic of consumer fraud, unfair business practices in the Slovenian market and consumers dealing with it in their daily lives. Due to the growing competition among businesses, struggle for survival in the market and making profit, the companies can use various tricks, with which they often cross the line of the law. The purpose of such tricks is reducing production costs. The one getting harmed by the process is the consumer - in the end, he is the one buying and using goods of poor and sometimes even dangerous quality. With this intention in mind the analysis of domestic and foreign primary and secondary sources was conducted. We have found that the ingenuity in deception is practically unlimited among both businesses and individuals. The consumer deceptions are also not limited to only certain areas of purchasing or contracting, but are lurking on consumers almost everywhere. They can be found in the selections of various goods in stores, shopping or just surfing on the internet. Malefactors can also try to exploit the consumer's compassion for another human being or use one's health issues for their own profits. Consumer is the one that has to be properly educated and informed, so that he does not fall for false marketing. We have conducted a survey in which we were interested in the presence of consumer fraud in our market and the understanding of differences in consumer frauds among Slovenians. We have found that Slovenian consumers believe that they are not sufficiently informed about consumer frauds and have frequent encounters with hoaxes in food markets. They believe that the regulation of consumer fraud and unfair business practices is not sufficient and the main reason for these frauds is the lack of supervision from competent institutions. We believe that prevention of unfair business practices and consumer frauds require cooperation between consumers and institutions, responsible for corporate control. There also has to be implemented cooperation between countries in the European Union due to the open and streaming market.
