magistrsko delo
Aleksander Hočevar (Author), Damjan Možina (Mentor)

Abstract

Ideja t. i.

Secondary title: Disgorgement as a damage claim
Secondary abstract: No one should make a profit by a wrong. It is a common principle trough out the world that is applied in many different ways. The main aspect in the master thesis is the application of this principle in Slovenian private law, through law of unjust enrichment, law of damages and through some articles of civil procedural law. Because some authors see in the principle of disgorgement elements of sanctions and punitive damages, a part of thesis is intended to present these two elements in the light of Slovenian constitution. Since the principle of disgorgement is well known around the world there is also a brief introduction on this idea in the United Nations Convention on contracts for the international sale of goods (CISG) and the use of this principle by the EU and US competition agencies.
