Otroštvo na Slovenskem v srednjem veku

primerjava med primorskimi mesti in mestom Ptuj

Abstract

Magistrska naloga se osredotoča na otroštvo v srednjeveških mestih Koper, Izola, Piran, Trst in Ptuj. Zgodovina otrok v srednjem veku je obravnavana na podlagi ohranjenih srednjeveških mestnih zakonikov - statutov. Otroštvo je tako opredeljeno predvsem s pravnega vidika glede na to, kakšno naj bi bilo glede na zapisan statutarni red. V osrednjem delu naloge smo glede na obravnavane člene iz različnih statutov zapisali o položaju otroka v srednjeveški družini, o dedovanju in pravici do dediščine, o družinskih konfliktih in nesoglasjih, o polnoletnosti in pravni sposobnosti otrok ter o kazenski odgovornosti otrok. V posebnem sklopu je opisan tudi položaj sirot. Obravnavane statute in ugotovitve smo med seboj primerjali. Ugotovili smo, da obstajajo velike podobnosti predvsem v statutih mest Izole, Kopra in Pirana, medtem ko se ptujska statuta od le-teh v večji meri razlikujeta. Predstavljene ugotovitve nam ne opisujejo dejanskega stanja in položaja otrok, ampak nam služijo kot vpogled v tedanji družbeni red.

Secondary title:	Childhood in medlle ages - comparison between istrian cities and city of Ptuj
Secondary abstract:	Focus of the Master's thesis is on the childhood in the medieval cities Koper, Izola, Piran, Trieste and Ptuj. Medieval children are discussed based on the found medieval legal codes - statutes. Therefore, the childhood is specified from legal aspect; based on the written act, our image of the childhood in the Middle Ages is described. Upon the considered acts of the Statutes, the main part of the thesis was written; it discusses the situation of a child in the Middle Ages, inheritance and inheritance rights, family conflicts and differences, age of majority and legal rights of the children, and criminal responsibility of children. Moreover, the situation of the orphans is described. Discussed Statutes and observations are compared. It was established that there are similarities between statutes of the cities Izola, Koper and Piran, while the statutes of Ptuj are different from the aforementioned ones. The observations do not show us the facts and the situation of the children; the aforementioned statutes serve us as an insight in the social order.
