Abstract

Temeljni cilj vsakega civilnega pravdnega postopka je izdaja pravilne sodne odločbe, s katero se avtoritativno in dokončno uredijo sporna pravna razmerja med strankami tako, da se strankam zagotovi pravno varstvo ogroženih ali kršenih pravic. Posledično se s tem vzpostavi tudi pravni red v družbi. Institut pravnomočnosti omogoča, da postane sodna odločba v določenem trenutku nespremenljiva in zavezujoča. Ker pa pravnomočnost ne velja neomejeno, omejena je namreč z mejami, se pri tem postavljajo vprašanja, kateri deli sodne odločbe postanejo pravnomočni (objektivne meje pravnomočnosti), na koga pravnomočna sodna odločba učinkuje (subjektivne meje pravnomočnosti) in na kateri trenutek se pravnomočnost nanaša (časovne meje pravnomočnosti). V prvem delu magistrskega dela je predstavljen institut pravnomočnosti in njegov pomen za civilni pravdni postopek ter celoten pravni red. Drugi del je namenjen osrednji temi magistrskega dela, predstavitvi instituta objektivnih mej pravnomočnosti. Prikazani so osrednji problemi, s katerimi se pri določanju obsega pravnomočnosti in identitete tožbenega zahtevka srečujeta civilna procesna teorija in praksa. V zadnjem delu magistrskega dela je prikazana primerjalnopravna ureditev instituta objektivnih mej pravnomočnosti, natančneje pravna ureditev v Republiki Hrvaški. Raziskane so podobnosti in morebitne razlike tematike navedenega instituta v obeh pravnih redih. V zaključku magistrskega dela so podani sklepi.

Secondary abstract: The primary goal of every civil procedure is to issue a correct court ruling, which authoritatively and conclusively regulates disputable legal relations between parties by ensuring the parties receive legal protection of jeopardized and breached rights. As a consequence this also establishes legal order in a society. Institution of finality enables that in a certain moment a court ruling becomes invariable and binding. But since finality does not apply unlimitedly, it is limited by restrictions, questions are raised about which parts of a court ruling become final (objective finality restrictions), who does a court ruling effect (subjective finality restrictions) and to what moment does finality relate to (time finality restrictions). The first part of this master’s thesis represents the institution of finality and its meaning for the civil procedure and the entire legal order. The second part focuses on the main subject of the master’s thesis, namely presentation of the institution of objective finality restrictions. It represents the main problems, which theory and practice of civil procedure encounter in determining the scope of finality and identity of a civil claim. The last part of this master’s thesis represents the comparative legal regulation of the institution of objective finality restrictions, more specifically, legal regulation in the Republic of Croatia. It investigates similarities and potential differences in the subject of the stated institution in both legal orders. The final section of the master’s thesis includes conclusions.
